Council agreed with staff findings that the waiver request violated the requirements of the Intergovernmental Agreement. However, because the project is being termed "affordable," Council recommended that the applicant's expenditures toward any improvement project be limited to a maximum of $50,000. The issue of waiver requests to the UGA Public Street Capacity requirements for County development proposals have become a concern of both the City and County. In November, 1995, Commissioner Duvall and Council member Apt discussed her concerns. She felt that communication and coordination on handling this issue could be improved between the County and City. At a subsequent meeting of the City's Growth Management Lead Team with County Planning Coordinator Russ Legg in attendance, this same issue was discussed. It was decided that Russ would meet with Commissioner Duvall to discuss the issue. The $700.00 fee should also be analyzed for possible increase since our analysis indicates it may not be adequate. This would provide the ability to improve and widen roads when traffic counts warrant and ensure all street development occurs at urban standards; Include the waiver requests to the UGA Public Street Capacity requirements as a specific item in the renegotiation of the Intergovernmental Agreement that is scheduled as part of the City Plan/PLUS process; and, The County consider limiting approval of development inside the City's Urban Growth Area. Again, this could be part of the future discussion on the Intergovernmental Agreement. Council would like to suggest this as a topic for our next joint meeting which is scheduled for March 28, 1996. As the waiver request violated the requirements of the Intergovernmental Agreement we have with the County, City Council recommended that the County Commissioners deny the road waiver request for the Aurora Hills Subdivision. However, because the project is being termed "affordable," Council recommended that development expenditures toward any improvement project be limited to a maximum of $50,000. A summary of what City Council suggests be considered at the County review on April 8, 1996 can be found on the second page of the attached letter. Box 580 Fort Collins, Colorado 80522 Re: Proposed Aurora Hills Waiver Agreement - Letter of Understanding Dear Mr. Byrne, This letter is written at the request of the City to define and acknowledge agreement as to the amount and terms for payment of the costs of improving Skyway Avenue to meet the requirements of the City of Fort Collins - Larimer County Intergovernmental Agreement for the improvement of Skyway Avenue from South College Avenue west to Constellation in connection with the development of the Aurora Hills Subdivision. City and County staffs have identified certain improvements of the existing asphalt surface which staff members agree are needed to support traffic generated as part of the proposed Aurora Hills Project. It is acknowledged and understood by the parties that certain additional improvements may be necessary to support use of adjoining properties as commercial developments, but such additional improvements are not necessary at this time. The cost of the improvements is estimated to be $50,000. This equates to $1,562.50 for each of the 32 lots in the proposed Aurora Hills Subdivision, which amount will be payable for each of the lots at the time of building permit issuance. The County will warrant that it will use the money paid as described above, only for improvements to Skyway and nothing else. Upon annexation of the Aurora Hills Project by the City of Fort Collins, the County will agree to forward to the City any unused funds collected from the Aurora Hills Project.
