These activities have been previously approved under a City Development Construction Permit. The security KB Home has in place also rovers this activity. Prior to beginning new water, sewer, storm, road work, etc. not covered by the currently permitted development work, Richard's Lake LLC will submit the documents necessary lot such work. Box 580 Fort Collins, CO 80522-0580 Dear Mr. Stringer: I am writing regarding the cross -pan on the north side of the intersection of Outrigger and Longboat Ways in Richard's Lake P.U.D., Filing 1. As you know, it was constructed with a width of 6.3' instead of 20' as required on the plans. However, it does exceed the City's minimum standards (which require a width of at least 6' or as mandated by the City Engineer). We will not recornmend removal and reconstruction of the cross -pan unless you require it for long term operational or maintenance related reasons. Collins, CO 80522-0580 RE: Richard's Lake Off -Site Road Comments dated July 29, 1999 The pavement design submitted by Inter -Mountain Engineering will need to be revised to address the high swell soils as indicated by the swell consolidation tests included in the report. Also the City will need to review the EDLA numbers used in the calculations of the pavernent thickness. RESPONSE: This situation was discussed with City representatives during a meeting held September 29, 1999 at the City of Fort Collins Engineering Department. At this time it was decided that this was an issue that needed to be handled internally by the City of Foil: Collins. Box 580 0 r` Fort Collins, CO 80522 rn Dear Mike: u_ This letter pertains to the request for a variance from the "Design Criteria and Standards for Streets" for the centerline radius of a local street in the Richard's Lake PUD. Whitesail o Cove is proposed to have a centerline radius of 143 feet. N There is existing water- and sewer utilities within this street rn 0 cross section that follow this alignment. There will be a 0 o stop sign at its intersection with Richard Lake Road. This rn street is classified as a local residential street. The posted :speed limit on these streets is typically 25 mph. With z this variance request, a residential lot on the inside of the 0 horizontal curve has been eliminated as a building site. r, z cc w z z ul z 0 F cc 0 0 a Z z a rz Ca U cc cc The standard centerline radius for a local residential street, from the cited reference, is 240 feet. The design speed is 30 mph for this radius. Using the 143 foot radius, the calculated speed is 2:3 mph with the same e + f value (0.-'5) used to calculate the 30 mph design speed. Based upon a review of the site plan for Richard's Lake PUD, it is estimated that there will be 100 daily vehicle trips, 7 morning peak hour trips, and 10 afternoon peak hour trips on this segment. These drivers will primarily be comprised of residents of this segment of Whitesail Cove. This cal c.l_'.`._�d speed, coupled with =--he familiarity of the users and the existing utilities, leads to the conclusion that the variance to the 240 foot centerline radius should be approved. The elimination of the residential lot will provide adequate stopping distance sight lines across the inside of the horizontal curve. The smaller proposed radii will not create a hazardous condition. Request for Variance from Street Design Criteria Dear Matt: February 17, 1998 This letter is in response to your letter dated February 2, 1998 in which you requested a variance from the City's Design and Construction Criteria, Standards and Specifications for Streets, Sidewalks, Allevs and Other Public Ways (the "Criteria"). The City's response follows: 1.02.03.03 Horizontal Radius In the proposed Richard's Lake development one street, Morningstar Drive (errantly called -'Parkside Drive" in your variance request letter), does not meet the minimum allowable centerline radius for a Collector street, as specified in Table 2 of the Criteria. Morningstar Drive is designed with a 530' radius which is les than the 610' minimum allowed in the standards. Because the posted speed limit on this street is anticipated to be less than the calculated design speett as detailed in your letter, the request for the variance of design standard 1.02.03.03 for Morningstar Drive is granted. 1 hope 1 have addressed all of your concerns. Bw0 580 • Fort Collins, CO 40522-o580 • 070) 221-n605 and Environmental Services Current Planning City of Fort Collins July 22, 2004 Richard's Lake, LLC c/o Mr. Scott Price 150 South Dahlia Street Denver, CO. 80246 Subject: Richard's Lake PUD, Filing 1 - Expiration of Portions of the Development Plan Dear Mr. Price, The City of Fort Collins has determined that portions of the approved Richard's Lake PUD, Filing 1 have expired because the Term of Vested Right, set forth in Section 2.2.11(D)(3) of the City of Fort Collins Land Use Code, has not been satisfied. This section of the Code states: Within a maximum of three (3) years following the approval of a final plan or other site specific development plan, the applicant must undertake, install and complete all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire hydrants and storm drainage) in accordance with city codes, rules and regulations. The period of time shall constitute the "term of the vested property right". It further states: Failure to undertake and complete the development within the term of the vested property right shall cause a forfeiture of the vested property right and shall require resubmission of all materials and reapproval of the same to be processed as required by this Land Use Code. All dedications as contained on the final plat shall remain valid unless vacated in accordance with law. The portions of the Richard's Lake PUD, Filing I development plan that have expired includes Lots 28 through 134 (single-family), Lot 294 (multi -family), Tract J (neighborhood park), and Tract U (commercial) because the required engineering improvements in these areas have not been completed within 3 years of approval of the final plan by the Planning and Zoning Board, being May 4, 2000.
