Re: Parking lot expansion
Dear Mr. Quinlan:
This letter is to notify you of the City's concern as it relates to the proposed
Collector Street along the east property line of your property. As you are aware,
the City's North College Avenue Access Plan shows this proposed street splitting
the east property line boundary in a north/south alignment connecting to Conifer
Street. Our concern is that the detention pond as it is proposed with your east
parking lot expansion conflicts with this street alignment and the pond will need
to be relocated in the future.
Since this parking lot was designed and constructed without the City's review or
approval we were not given the opportunity to suggest that the pond be located
in a different area or be configured in a way that the street and pond would not
conflict with one another. Therefore, the intent of this letter is to reach an
agreement that should the detention pond need to be relocated or reconfigured in
the future, the necessary work will not be the City's responsibility. It is our desire
that any future work and costs associated with this pond become the
responsibility of the property owner. The property owner shall be responsible for
ensuring that the future pond will be in compliance with the City's stormwater
criteria and flood plain regulations. In addition, it is the City's desire that 33 feet
of additional !right-of-way, as measured from the eastern property boundary to the
west, be dedicated at this time for the future Collector Street. If it is not feasible
to dedicate the right-of-way to the City at this time, please be informed that any
future expansion or redevelopment, or change of use to this property will require
the right-of-way dedication.
On another issue, In the City's meeting with your consulting engineer, Dennis
Messner and two of your employees, issues with the east parking lot construction
were discussed along with the City's views and concerns. In addition, I stated
that before the City will accept the design for this construction and approve the
Minor Amendment for this project, the following issues will need to be resolved.

The newly constructed pond shall be certified by a profession engineer that it
has been built as designed and that the blueline/redline plans be signed and
stamped by a professional engineer. This certification document is to be
submitted to Glen Schlueter of the City Stormwater Utility Department.
Included in this certification is a statement that the parking lot elevations will not
create a rise in the Dry Creek Floodway.
2. An easement dedicating this detention pond to the City will be required. This
easement insures the City that the detention pond functions as intended or is
not removed without the City's knowledge.
For your use I have enclosed information and forms for this easement dedication.
Please have your engineer provide the requested information to me and I will
schedule the acceptance of the easement with City Council for the next available
Council meeting after receipt of the proper paper work.
3. The responsibility for the future relocation and or reconfiguration and
associated costs of the detention pond shall be the responsibility of the
property owner.
If you agree to the terms as stipted in this letter, please sign and return the
original letter to me.
