First of all, let me remind you again that our Land Use Code is quite clear. Sections 1.2.4 and 2.1.3(D)(2) state that development of any site cannot occur before final plan approval, and stockpiling of fill material is part of the definition of development. The letter, as well as the apparent intent, of the Land Use Code is to restrict any development activity from beginning on a site before the final development plans have been approved. In some cases, this may seem too restrictive. I realize that there may be some situations where it makes sense to allow a contractor or developer to take advantage of opportunities to obtain available fill dirt. For this reason, we are initiating a process to seek a change in the Land Use Code that would allow for a Minor Grading Permit. The decision on this will probably not become final until May of 2000, and I cannot predict what that decision will be. I will, however, commit to keeping :you informed as we go through this process. In the meantime, I need to request a commitment from you. I believe I can take the risk of allowing the fill on your site to remain, if you agree to the following conditions: (1) No more fill dirt can be imported onto your site until the final plans are approved and a Development Construction Permit is issued. Similarly, no other development activities can occur on the site either, until the plans are approved. (2) For the existing; stockpile of fill dirt, you are required to maintain erosion control measures in accordance with instructions from our Stormwater Utility Department (Bob Zakely). (3) Adverse impacts to adjacent property owners or complaints from the public may be grounds for requiring the immediate removal of the existing fill dirt. 281 North College Avenue • P.O. Please signify your agreement with these conditions by signing below, and return one signed copy to me. I am also enclosing; with this letter a copy of Appendix Chapter 33 of the Uniform Building Code, as you requested. This prescribes a procedure after which we may model our Minor Grading Permit. The utility revisions include, but are not limited to the following: General Comments ♦ Redline comments on blue lines have been addressed. Utility Plan Comments ♦ All water and sewer lines are shown in a blanket utility easement. ♦ VF Ripley will provide cross section exhibit for the internal walk/drive intersection. Elizabeth Street Plan and Profile ♦ The cross slope is a straight line grade from the crown to the lip of new gutter adjacent to the new pavement. The street cut and repair has been extended to the centerline of West Elizabeth Street. ♦ The constructed curb and gutter is labeled to be 6" vertical curb and gutter. ♦ A cross section of the widening of West Elizabeth Street has been provided at 50 foot increments. The cross slope for widening Elizabeth Street maintains a minimum of a 2% cross slope. The full cross section is shown and properly labeled according to redline comments. ♦ A signing and striping plan has been included with this submittal set. ♦ The soils report has been updated. ♦ The curb cuts and parking lot configuration has been redesigned so the one-way drive aisle functions properly. The pedestrian refuge will not be required with this project. General Details ♦ The driveway detail has been revised. ♦ Redline comments have been addressed. Plat Comments ♦ Comments handled by Landstar Surveying Inc. Soils Report Comments ♦ Soils Report has been updated and will be provided by the developer. Traffic Impact Study Comments ♦ Both of the access points into this project have been revised to function as right-in/right- out. No shared access point is required between KFC and this project.
