Horsetooth Road, Suite 300 Fort Collins, CO 80525 RE: Registry Ridge PUD I't Filing — Trilby Road Railroad Crossing Dear Gregg: In accordance with the Development Agreement for the above titled project, the Developer is obligated to escrow funds with the City in the amount of $58,000 to guarantee completion of the railroad crossing improvements. In our conversation last fall, I explained to you that the BNSF Railway Company wanted to enter into the agreement with the City rather than the Developer for completion of the improvements. In order to do that, it requires that the Developer pay the City the amount necessary to cover the railroad improvement costs, before the City can enter into the agreement with the BNSF. You mentioned that that would work for the Developer. You may want to amend the Development Agreement to match the revised conditions. Contact Sheri Wamhoff to do the amendment. We just received the estimate from the BNSF. Attached for your review is a copy of the BNSF letter transmitting the estimate and an agreement. In addition, I talked with Bob Carter, the person who sent the letter, about the possibility of the actual cost being greater than the estimate. The possibility does exist. Therefore, I request that you deposit with the City cash in the amount of $40,000 to cover the costs. Any funds remaining after the final billing from the BNSF, will be reimbursed to the Developer. I must receive these funds before I can take this agreement to the City Council, to appropriate the funds and for the City to enter into the agreement with the BNSF. As soon as I receive the $40,000, I will proceed with the crossing project. I will not hold it up for a revised Development Agreement. 281 North College Avenue • P.O. Water Association Dear Ms. Miller: 'file intent of this letter is to verify that the street construction on South Shields Street is an interim improvement. The Land Use Code of the City of Fort Collins requires all developments have access to an improved Arterial Street ( with this project Shields is the arterial), and if the access does not exist, they are required to upgrade the street to a thirty-six ( 36 ) foot wide cross- section on a base adequate to accommodate the ultimate design, or they must construct the arterial in accordance with the City design standards criteria, ( this would be the ultimate design). In most cases developers elect to construct the 36 foot interim design at their cost. Which is the case with the Registry Ridge Development. For your information I have inclosed a copy of the cross-section that will be similar to the ultimate design of Shields Street as well as a drawing that shows approximately what is being constructed as an interim improvement by the Registry Ridge developer. As I stated previously, the Shields Street design proposed by the Registry Ridge developer is an interim design and Shields will be improved to the ultimate design with a cross section as per the attached detail sometime in the future. Liley March & Myatt, P.C. 110 East Oak Street Fort Collins, Colorado 80524 Dear Ms. Liley, This letter is in response to your request for a variance to the Street Design Criteria for Street Lighting for the Registry Ridge PUD First Filing, addressed to Gary Diede on March 27, 1997. The request was for a reduction in the required number and wattage of street lights along Trilby Road, particularly west of Ranger Drive. In addition, the request was for a reduction in the number of street lights adjacent to the large lots on Forestel Drive and Wainwright Drive of the Registry Ridge PUD First Filing. First, the Director of Engineering has determined that street lights will be only installed on the south side of Trilby Road at the intersections of Trilby Road / Ranger Drive and Trilby Road / Shields Street. No additional street lights will be installed on the south side of Trilby Road at this time due to the location of Tri- State power lines. However, when the construction of Trilby Road is fully complete (curb, gutter, and sidewalk on the north side of Trilby Road) it is anticipated that street lights will be placed along the north side of Trilby Road in accordance with the City Street Standards that are in effect at that time. Second, the Director of Engineering has denied the request to reduce lighting on Forestel Drive and Wainwright Drive- Standard street lighting will occur along these streets. In support of this decision the director notes the following: The combination of a distance of more than 400 feet including a row of single-family homes between the existing homes on the north side of Trilby Road and Forestel Drive provides an adequate transition from rural to urban lighting conditions. Registry Ridge PUD is an urban development. Therefore, urban lighting standards are appropriate. If you have any questions, please call me at 221-6750.
