Fort Collins, Co. 80521 RE: Ground water, The Ponds at Overland Trail 1s` Filing Dear Ms. Barnett: � r r V 1 Lf-tslp W The intent of this letter is to summarize and respond to our meeting of October 18, 2000 with Jay Barber, Glen Schlueter and myself at the City Stormwater Utility's office, 700 Wood Street. During our meeting you expressed frustration and concern that the Developers of the Ponds at Overland Trail 151 Filing and your homebuilder, US Homes, were not seriously addressing your concerns regarding the ground water seepage impacting your property. In addition, you discussed several problems with the construction of the home as well as soil settlement problems that are occurring on your property and the surrounding homes. For the intent of this letter, I will only address the groundwater issue. As you know we discussed several conditions which may be a cause or contributing factor in the large amount of groundwater seepage occurring on your lot. That is, possible broken, plugged or removed subdrain tiles that were in place when the entire parcel of land was used for agricultural purposes, surrounding sump pump discharges not properly installed to the underground subdrain system and perched water conditions that may be a result of yard watering for new lawns in the development. We briefly discussed some options for mitigating the groundwater condition, none of which have occurred as of this date. In addition, Jay Barber informed you that the Developer has recently received approval from the City, to install a ground dewatering system in the detention pond northwest of your lot. It is the City's understanding that the contract for this construction has been awarded by the Developer and construction is scheduled to start in the coming weeks. Once this system is installed it may eliminate the groundwater problem you are currently experiencing. However, there are no assurances that this system will eliminate the problem completely, though it should help. I can assurance you the City Engineering Inspection Department will monitor this work , and the sump pump discharge connections to the subdrain lateral system closely. Thank you for taking the time to meet with us once again on this matter. Please understand that the City shares your frustrations completely. Unfortunately, groundwater seepage is a complex issue that is difficult to understand and control. It is an issue that the City has attempted to address in our design standards. When the presence of groundwater is known, developers are required to have professional engineers design subdrain systems to mitigate the impacts to homes. But, their methods are not always successful. Fort Collins, Co. 80521 RE: Ground water reports —The Ponds at Overland Trail 1st Filing Dear Ms. Barnett: I apologize for the tardiness of my response to your letter dated September 14, 2000. In your letter you asked for some additional information concerning subsurface water reports prepared for the Developer by their consulting engineers. I regret to inform you that the City does not have any additional information or the follow up reports described in your letter. I suggest you contact Terracon Consultant, 301 N. Howes Street, Fort Collins, Co. 970 — 484 — 0359, Riverside Technology, Inc., 2290 East Prospect Road, Fort Collins, Co., 970 — 484 — 7573 and/or Ayres & Associates, 3665 JFK Parkway, Building 2, Suite 200, Fort Collins, Co. 80525, 970 — 223-5556. If any additional testing was performed by any of these firms they should have the appropriate information. Fort Collins, CO. 80521 September 14, 2000 Mr. David Stringer, Development Review Manager c/o City of Fort Collins 281 North College Avenue Fort Collins, CO. 80522-0580 Dear Mr. Stringer: This letter is in regards to the Goundwater Investigation Reports for the Ponds at Overland Trail which were dated in 1995. After reviewing the reports, I noted that there were to have been further monitoring reports on the wells on a monthly basis for a minimum of 1 year. This recommendation is on (pg. 17 paragraph 2) of "Ground Water Investigation" prepared by Riverside Technology, Inc. Owen Ayres & Associates, Inc. (pg. 40 number 10) state monitoring periodically (monthly or quarterly); and finally in Terracon Project No. 20955101 (pg. 6 paragraph 2) periodic measurements over a sufficient period of time. Additionally, throughout a few of the reports other references were cited which may be of benefit to the ground water problem here on the development. I would appreciate it if you could either locate the additional reports or direct me as to where they may be obtained. Once again, thank you for your assistance in this matter. KFUIZIL May 3, 1996 VIA FEDERAL EXPRESS Ms. Kerrie Ashbeck Civil Engineer 11 City of Fort Collins 281 North College Avenue Fort Collins, CO 80522-0580 RE: The Ponds at Overland Trail, First Filing / Additional Easements & Deed Dear Kerrie: As we previously discussed, enclosed are originals and copies of various easements executed in connection with the final plat as follows: Easements Granted to the City: As we discussed on the telephone, Gateway American Properties LLC ("Gateway") will convey a right-of-way easement for a turnaround at the end of Prospect Road. This temporary easement will be replaced by a dedicated right-of-way when the property covered by the easement is later developed. Gateway also will convey two temporary access and utility easements to cover some sewer facilities at the intersection of Golden Currant Boulevard and Banyan Drive. These temporary easements also will be replaced by permanent easements when the next phase is developed. I have enclosed the originals of these three easements, per the form approved by John Duval. We set these up with Gateway as the Grantor since they may record after Wally Noel transfers the property to Gateway. On the day of our closing, we will insert the recording information in paragraph 1 of the easements, and I will sign the attorney's certification. Easements Granted to Others: We have a number of easements which Gateway will receive or convey to others as part of the recording of the plat. First, Rex Miller will convey the Temporary Easement in connection with the construction of Prospect, and Gateway will convey a small parcel of land to him in exchange for the property he dedicated for additional right- DEUTSCI], SPILLANE & REUTZEL, P.C. You are holding the original dedication of the additional right-of-way, and enclosed are copies of the Temporary Easement and the Special Warranty Deed. We will have Transnation "title Company hold the originals in escrow to record at closing. Secondly, Gateway will grant two easements to the Fort Collins -Loveland Water District, and copies of these easements are enclosed. Lastly, Gateway will grant two easements to the Pleasant Valley and Lake Canal Company covering the property currently being used for the ditch. There is no casement of record, and Gateway will execute a formal easement to avoid any later dispute over prescriptive rights. The originals of these four easements also will be held by the title company. Tom Di Rito forwarded a copy of the revised Development Agreement today, but I have not had an opportunity to review it.
