RE: NRi buildings, utility easements Dear Tom: The intent of this letter is to bring foreword the City's frustrations as it relate to CSU's lack of cooperation in granting utility easements to the City. More particularly, in those areas adjacent to the existing building A and the proposed building B in the NNRC site. As you may recall, when the NRRC building A was submitted to the City for it's advisory review we made note of the fact that easements were needed in those areas where public water, sanitary sewer and storm sewers were installed to serve the NRRC buildings. This is still a requirement and is applicable to building B and any future buildings in this project that may utilize public infrastructure. It is standard City policy to obtain easements for maintenance reasons and land use development regulation 29-643 (5) states in part:, "plats shall contain the following information"; "The boundary lines of the subdivision, right—of-way lines of the streets, easements and other rights -of -way, irrigation ditches and lot lines, with accurate bearings and distances"; typically easements when shown on plats are granted to the City as the time of recordation. However, for those projects that are exempt from City subdivision regulations we receive easements through separate documents. As we discussed in our meeting yesterday afternoon it is important to the City Utility Departments that easements are obtained which will allow them the right to enter private property and maintain their lines. Therefore, I ask for your cooperation in working with CSU to help the City obtain the appropriate utility and easements needed for buildings A and B.
