HomeMy WebLinkAbout6130 RIGHT-OF-WAY - Filed RD-ROW DEDICATION - 2010-07-19RECEPTION#: 20100026130, 05/10/2010 at 02:46:17 PM, 1 OF 4, R $21.00 TD Pgs: 0 Scott Doyle, Larimer County, CO 4010-o3 DEED OF DEDICATION FOR RIGHT-OF-WAY KNOW ALL MEN BY THESE PRESENTS: That the undersigned IMAGO ENTERPRISES, INC., a Colorado corporation ("the Grantor"), being the owner of certain real property in Larimer County, Colorado, legally described at Reception No. 1999-0040017 of the Larimer County, Colorado records ("the Records"), in consideration of Ten Dollars ($10.00) in hand paid, receipt of which is hereby acknowledged, and other good and valuable consideration, does hereby dedicate, transfer, and convey to the City of Fort Collins, Colorado, a municipal corporation, for public use forever a permanent right-of-way for public street purposes in the City of Fort Collins, County of Larimer, State of Colorado, more particularly described on Exhibit A attached hereto and by this reference made a part thereof, subject to a twenty foot (20') wide utility easement dedicated to the City of Fort Collins by instrument recorded at Reception No. 2002-020075 of the Records. In addition to the foregoing Dedication for Right -of -Way, the Grantor, being the owner of both the property benefited and the property burdened, hereby vacates any easement or right-of-way that may have been created or established by the language "subject to a thirty foot (30') road right-of-way along the west line of subject premises" contained in that certain Warranty Deed dated December 21, 1971 and recorded December 23, 1971 in Book 1487 at Page 159 of the Records. It is understood by the undersigned that, by acceptance of this dedication, the City of Fort Collins will not accept the duty of maintenance of such right-of-way until permanent improvements have been made and accepted by the City.
