RELEASE OF PIPELINE EASEMENT
THIS RELEASE OF PIPELINE EASEMENT is made and entered into by
NORTHERN COLORADO WATER ASSOCIATION, a Colorado nonprofit corporation,
hereinafter referred to as "NCWA," whose legal address is 4389 East County Road 70,
Wellington, CO 80549 for the release of a pipeline easement burdening the real property
of MERTEN, INC., a Colorado corporation, hereinafter referred to as "MERTEN,"
✓t(vhose legal address is 55 South 32"d Street, Boulder, Colorado 80305.
RECITALS
A. MERTEN owns real property described as the North 15 acres of the
Northeast'/4 of the Northeast'/4, Section 2, Township 7, Range 69 West of the 61' P.M.,
Fort Collins, County of Larimer, State of Colorado, EXCEPT that portion thereof
conveyed in Deed recorded November 26, 1976 in Book 1735 at Page 134 and also
EXCEPT that parcel of land conveyed in Deed recorded February 3, 1998 at Reception
No. 98007877 and also EXCEPT that parcel of land conveyed to the City of Fort Collins,
Colorado in Deed recorded March 3, 1999 at Reception 99018609 and re -recorded March
25, 1999 at Reception No. 992025160. a/k/a Parcel No.: 97021-00-001 ("Property").
B. There is a pipeline easement appurtenant to the real property recorded in
the Larimer County Clerk and Recorders Office at Book 1387 Page 789, Reception No:
949219, recorded June 20, 1968.
C. NCWA is willing to release its easement rights to that portion of the
easement located on the Property.
RELEASE
NOW, THEREFORE, in consideration of ten dollars and other good and valuable
consideration, the receipt and adequacy of which is hereby acknowledged, NCWA agrees
to the following:
1. Incorporation of Recitals. The above Recitals are incorporated into this
Agreement as substantive terms.
2. Release of Easement. NCWA releases its entire interest in and to its
easement rights for a pipeline located in that portion of the MERTEN Property known as
the Union Place P.U.D. as described in Section A. above.

3. Binding Effect. This Agreement is binding upon and inures to the benefit
of the NCWA and its successors and assigns.
