Dear Mike: This is a formal request for the vacation of certain rights -of -way in the Horsetooth Commons P.U.D. area that are no longer required or valid and need to be vacated to accomodate the proposed filing plat of KINGSTON WOODS P.U.D. SECOND FILING. Please find attached land descriptions and exhibits of said rights -of -way being requested for vacation. I am asking that this vacation request proceedure be heard at the October 6 and October 20. 1992 City Council meetings, so as to not delay the project. Collins, CO 80521 RE: Request for vacation of pre-existing rights -of -way within Horsetooth Commons P.U.D. Dear Mike: I am requesting that certain exi:ting public rights -of -way within the recently approved Horsetooth Commons P.U.D. be vacated. These rights -of -way are no longer necessary and are in conflict with the recently approved plat. They are as follows: 1. Jane Street (see attached deed of dedication) Legal Description: A tract of land in Sec. 27, Twp. 7 N. Range 69, W. 6th P.M.: Considering the East line of the SE 1/4 as bearing North and with all bearings herein relative thereto, contained within the boundary lines described as: commencing in the Southeast corner of Section 27, Township 7 North, Range 69 West of the 6th P.M., and run thence N. 563.25 feet; thence N. 89°44'16" W. 30 feet to the true point of beginning; thence N. 89°44'16" W. 790.01 feet; thence S. 50 feet; thence S. 89°44'16" E. 790.01 feet; thence N. 50 feet to the true point of beginning. 2. Two pieces of street right-of-way at the intersections of Shields and Richmond Drive, and Horsetoo-:h and Richmond which lie outside the platted right-of-way of these streets. These areas consist of approximately 14.45 sq. ft. '.
