However, we reserve the right to require overlays of any existing streets which are damaged by your construction operations. v'de will make that determination at the end of the project. Assuming your contractors perform as you say they will, there will be no need for an overlay on JFK Parkway. I am enclosing a copy of our newest standards for patching and repairing streets. This will affect the way your water tap is repaired upon completion. Please share this with your contractors, and help us "get the word out" that our repair standards have been recently upgraded. I will check with Roger Buffington to be absolutely sure that water has not been stubbed out on the east side of JFK. That, of course, would be exceedingly good news for all of us since JFK is virtually brand new and we would like to avoid cutting into it at all. 2. Electric, gars, and telephone are all stubbed out on the east side of JFK, so we have no street cuts or problems with respect to them. 3. In the event that we do have to cut JFK, as we discussed, it will be for (a) combination of water and curb cut for office part of project, (b) curb cut for residential entrance and (c) possible replacement of a portion of asphalt with a concrete crosswalk, if we are unable to do a painted crosswalk. I want to confirm that it is my understanding, and what both you and Gary Diede have stated, that if we do a quality job as relates to these three items which impact JFK, that we will not be required to overlay JFK. I can assure you that we will do the most careful and best possible job possible as relates to all work impacting JFK. Thank you for your help in moving this excellent project forward. Best regards. I am very concerned that we have assurance from Engineering in advance that we not be required to overlay JFK where it fronts on this project, as the additional cost which this would involve would, in fact. be the death knell forthis project. Accordingly, we have re -designed the engineering to loop the water so that we only have to have one street cut on JFK for water. Since our project entrance is at mid -block on JFK, we will have a cross -walk there; however, we expect It will be a painted, mid - block cross -walk and therefore have no affect on the integrity of the street. In the unlikely event that the asphalt is cut for a concrete cross -walk to be installed, this will not involve any patching as you pointed out, since the asphalt will be cut with a saw and replaced with concrete for the cross -walk. Therefore, if this contingency comes about, it will not be considered a second street cut for the purposes of possibly triggering an overlay. 1 appreciate your assurances about this and will discuss it with Cam McNair, also. By ordinance, the property owner is responsible for a portion of these improvements called the "local street share", when the property is developed. Because the City constructed the improvements along the frontage of your property, the City may ask for a reimbursement when you develop or redevelop your property. AP A notice of this reimbursement obligation will be filed with the Larimer County Clerk. This is not an invoice for payment. I think he has made up for his lack of experience with ability, good common sense, good people skills, and hard work. In his ab aenc:e he indicated I should speak with you about the Development Agreemont and engineering matters for this project. I may have some questions to meet with you about regarding the development agreement language. However, I also wanted to clarify one matter with you relating tD the plat. We designate small tracts on which the buildings will be built. These ale not technically building envelopes but are separate tracts because ownersh p to same will be transferred to purchasers. In fact, they are very close to buildir g envelopes / building footprints, but are slightly larger than the actual building cotprints in order to accommodate the potential of a window well, for example and/or several inch mistake in concrete work or whatever. This slight oversizirg tract, easily between 6 inches and 2 ft., anticipates and solves these problems whiich otherwise come up to haunt you as encroachments and title problems at a later date. According to our final utility plans we have approximately 905 linear feet of 6' sidewalks adjacent to this site. It is our understanding that our client, Lagunitas Companies, would be required to install 4.5' of sidewalk adjacent to his site. Therefore, the remaining 1.5 foot of width would be the responsibility of the City. 905 linear feet * 1.5' add. width * $2.50/square foot sidewalk = $3393.75 Please call if you have any additional questions regarding these calculations. Box 580 Fort Collins, CO 80521 Re: Courtyard Commons - Utility Coordination Dear Mark: Enclosed for your information is a color coded copy of the utilities coordination plan along with the overall utility plan (so you can see how the dimensions work out) and the site plan (so you can see the building envelopes). After many Ihours of meetings with utilities engineers, I am confident that we have met the utility requirements for necessary installation and service in advance of completing our planning and engineering. In further regard to utilities as we have discussed, we are using a blanket utilities easement concept, identical to what we did in the adjacent Landings Office Park. This enables utilities to go anywhere on the property except building envelopes and creates a much bigger latitude and flexibility for coordinating utilities and allowing them to be properly installed. It is important to us to loop the water from the existing Landings Office Park down through the office, through the residential, and out to Landings. This accomplishes the required looping, but avoids having to make two street cuts in JFK which might otherwise be required, and which we absolutely do not want to make.
