College Avenue Fort Collins, CO 80522 Current Planning, Below is the statement of planning objectives for the new LDS Church on Lot 3 of the West Chase PUD. i) The objective of the LDS church is to become part of the neighborhood community. This is achieved by having the church located on the site within close proximity to the residential homes but also next to the future daycare center. The church has chosen materials that will blend with the neighborhood materials to provide a strong architectural connection. The site is generously landscape at 45.5% openness. The building footprint uses only 11.5% of the site. ii) The LDS Church is proposing a future 30' x 60' open structure pavilion on the north end of the site. This will be for picnics, family functions and possible recreational activities. The site has many trees and the is building set far back from the Timberline and Trilby intersections. There is landscape buffing along Timberline with a grade drop for separation. iii) The LDS Church plans on maintaining ownership of said property and will maintain the open areas, landscaping, site easements, and sidewalks along their property lines. iv) Their are no church employees that will be working in the building day on Sunday this access will operate as normal driveway which has the spacing criteria of only 50'. There will be no health, safety or welfare problems created by this variance. please accept this request for variance as reasonable solutions to the constraints of the area. See attached environmental report. viii) This project was annexed into the city from Larimer County. There was no neighborhood or neighborhood meeting during development and acceptance in the county. It was understood and accepted by the city of Fort Collins that a church was to be built on Lot 3. ix) Previous project name was West Chase Church. Please review all submitted documents and drawings. I am one of the users of the pipeline's irigation water. However, as I mentioned in our conversation the Westchase Homeowner's Association owns the pipeline and they are financially liable for any future repairs that it may require. I now have further information which I believe that you should have. The HOA's management firm is Management Specialists in Denver. Their phone number is 303-754-0721 The president of the Westchase HOA is Mr. Bill James of U.S. Homes. (The actual homeowners have not yet become officers in the HOA because the builders still control a large percentage of the building sites.) His phone number is 303-944-4983. I had my real estate attorney review the contract between the water users of the pipeline and the Westchase HOA. He advised me that if I am a party to any changes in the pipeline condition, now that it's construction has been completed, I may be tainting the maintenance contract --essentially voiding it. This contract refers to "The Pipeline" and defines "The Pipeline" as it was designed to be constructed in the original Westchase drawings. Were I to agree to change the pipeline design in such a way that increases the financial liability of the HOA, I am essentially voiding our agreement. So I must go on record as opposing any changes in the manhole height or earth cover over the pipeline. (I contacted the pipeline manufacturer and we are already at minimum cover per their specifications.) I also spoke with Mr. James who represents the HOA. He also agreed that he could not support any changes in the pipeline condition, as he has a responsibility to the present and future Westchase homeowners regarding their liability in this matter. So, what started out as an engineering question has become a legal question instead. It is not relevant that lowering one of the pipeline's manholes may not cause water to overflow the manhole. The real problem is that the contractual arrangements between the water users and the pipline owners will not permit changes in the pipeline that increase the HOA's financial risk. At the current time, none of the water users nor the HOA will approve of any changes in manhole height nor earth cover over the pipeline. We are requiring that the church architect make no changes to the topography of the pipeline easement and to make no changes to the pipeline itself. I am informing Park Engineering in Denver (303/651-6397) of these facts. I would greatly appreciate you keeping me informed of any meetings that may take place regarding this issue in the future so that I can represent our interests. I truly wish that I could be more accomodating to the church architect but, under the current circumstances, there is no way that any of us will agree to what they are proposing. Because of the delay for the unexpected raptor buffer zone modification process they had to go through and because a condition of that modification was timing of construction constraints (can't do work on the site or exterior of the building between March 1- July 15), they must either break ground pronto or wait a year and a half to build the church. We all knew this was the case, and Jeff Krueger had indicated to me and to Jeff Scott a few weeks ago that he had addressed all the issues from the first round of review. Clearly we saw that that wasn't the case at staff review. I let Jeff Scott know that if they wanted to break ground in November (and yes, I made it clear that that was a very ambitious goal), that Jeff and the engineer would need to get a move on the comments and communicate with us to make sure they really had everything addressed to Code. Jeff Scott decided that the best course of action would be to hire a different architect. He's hired the best he's got in Colorado- unfortunately Brian is in Colorado Springs so I imagine there's going to be increased running around and headache (for Jeff Scott anyhow). I've emailed Brian Keys to give him a heads -up that our Code is available on the web, and I've assmebled info from the first and second round of review. We've got the meeting scheduled on Tuesday to get Brian, Jeff Scott and the engineer up to speed. It is Jeff Scott's fervent hope that with Brian's expertise they can get everything in good shape in time to break ground in November. The way I've left it with Jeff Scott is that if they can address the issues that we need resolved to go to hearing pronto, I will arrange an informal review and schedule their hearing as soon as possible, though that will be about 3 weeks out from when they're ready because we need time for public notification of the hearing. Meanwhile though, I've told him that they should be working fast and furious on all the rest of the issues and that they should initiate the final compliance round of review as soon as possible. I've told him that final compliance can overlap the hearing process since I don't anticipate any problems with the PDP getting approval. I've let Jeff Scott know that I will do my part to make sure the transition is smooth and that we will work to get them through in time. He knows that it comes down to what we have to work with from the new architect and engineer. Sheri just came in to tell me there are potential problems with the irrigation users, so now that I've written you all a tome, I've gotta go put out another fire. The new architect is from Colorado Springs and is his most competant architect in Colorado. He says this guy should be able to address everything very quickly. He still hopes to be able to break ground in November. The new architect (I don't know his name yet) is hoping to meet with us this coming Tuesday, October 4th to get a jump on this. He will review the plans on Monday. Jeff Scott will Fedex them to him on Friday. SO: #1. When can you meet on Tuesday? We won't start until at least 10 am since he's driving up from Colorado Springs. I conveyed to the engineer the difficulties that would be created by changing any part of the pipeline construction or its cover. He accepted our inputs and conveyed his understanding. He also informed me that --at that moment, at least --he would attempt to revise his topography for the project and not intrude onto the pipeline easement with any signficant changes of our concerns. So, I'm not sure what plans you were given most recently to review. I myself have never received a set of plans. All of my information about this project came to me verbally by phone calls from Park Engineering. Thank you for keeping me informed. I would like to attend your next review meeting on this subject and meet all of the participants. At this time I do know that the architect is trying to schedule a meeting for next Tuesday with the City to go over the comments on our latest round of review. It maybe of interest to you that the plans that were submitted for the City review showed no changes to the irrigation line other changes to the grade above the pipe. There was no mention of any changes to the pipe line itself. With that I wondered if we were both seeing the same set of plans. City of Fort Collins Engineering Division 281 North College Avenue Fort Collins, Colorado 80522-0580 RE: Request for Variance of Access Separation Fort Collins Stake Center Dear Sheri: The Fort Collins Stake Center is located on Lot 3, Block I of the Westchase P.U.D. 2°d 1'iling. As part of the site planning for access, an access drive onto to Carmichael Street near the northeast corner of the site was proposed. This access point is near the intersection of "filden Street and Carmichael Street. While developing the site plan it was determined that the north access into the Church could only be a one way in order to eliminate the sight distance conflict with the adjacent property. A sight easement could not be negotiated with the property owner. As such, this access still does not meet the requirements for "Spacing" per Section 9.2.6 (A) of the Larimer County Urban Area Street Standards. Said section refers to Table 7-3, which shows that the spacing between a high volume driveway and an intersection is to be a minimum of 150'. The proposed driveway for this Project is 100' south from the intersection of Tilden Street and Carmichael Street. This letter is submitted as a request for variance to the spacing standard to allow 100'of spacing instead of the 150' spacing standard. Variance For Spacing Due to the access limitations for this site and Fire Department emergency access requirements, two access points are required to connect to Carmichael Street. In order to facilitate the proposed building, access points were proposed south and north along Carmichael Street. Alternate designs were evaluated but the proposed layout became the only reasonable solution based on the constraints of the site. The proposed variance, as described above, will not affect the maintenance or the life expectancy of any public or private improvements or facilities. Since the turning movements into this north access are limited to "in only" conflicts with the adjacent intersection will be significantly less than a full movement drive. During periods of high volume, which are limited to short periods on Sundays, free now conditions will prevail.
