Box 580 Fort Collins, CO 80522.0580 970.221.6605 970.221.6378 - fax kgov. com/engineering Re: Vacation of a portion of right-of-way north of Cherokee Drive and between Lots 6 and 7 of the Indian Hills Subdivision First Filing Dear Mr. Bennett, This letter is to notify you that a request for the vacation of some existing right-of-way (property dedicated to and owned by the City) adjacent to your property has been made. The attached drawing shows the area requested for vacation. Although this area is labeled as "cross walk" on the plat it is legally considered right-of-way. The City Parks Department is requesting the vacation because it is not needed for a pedestrian connection from the park to the street. The request has been routed to the utility providers and so far they are all okay with the vacation of the property provided that the area is retained as a utility and drainage easement. In accordance with City Ordinance No. 106, 2004, property owners in the vicinity of the right-of-way vacation shall be notified of the request before a recommendation for approval or denial of this request is made. If a recommendation for approval is made, the request shall be forwarded on to City Council for their consideration of action by ordinance to vacate the right-of-way. Upon approval of the vacated right-of-way, the property being vacated by the City will go back to property owners in accordance with State Statues.
