FL-- ORDINANCE NO. 98, 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE RIGHT-OF-WAY OF STUART STREET WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of the right-of-way of Stuart Street, set forth in more particular below; and WHEREAS, because of the development of Parkwood East Second Filing and the Natatorium and Ice Arena, it is no longer necessary that Stuart Street be built through; and WHEREAS, in conjunction with this vacation, the City will also be retaining the utility and access easement for said portion of the right-of-way of Stuart Street; and WHEREAS, all utilities have been contacted and have no problem with this vacation: and WHEREAS, the rights of the citizens of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of the right-of-way of Stuart Street, set out more particularly as follows, to wit: A tract of land located in the N 1/2 of Section 19, Township 7 North, Range 68 West of the 6th P.M., City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows: Considering the North Line of said N 1/2 of Section 19 as bearing N88°59'40"W and with all bearing contained herein relative thereto. Commencing at the North 1/4 corner of said Section 19; thence along the north line of said Section S88° 59'40"E, 1321.73 feet, thence S 00°03'20"E, 1710.03 feet, to the point of beginning. Thence continuing along the same bearing SOO°03'20"E, 40.00 feet along the west right-of-way of the Union Pacific Railroad; thence leaving said right-of-way N89°57'44"W, 1037.22 feet; thence along a non -tangent curve concave to the northwest 71.58 feet, whose chord bears N53° 13'25"E, 66.75 feet, and whose central angle is 73'37'42" and a radius of 55.70 feet; thence S89°57'44"E, 720.41 feet; thence along a non- tangent curve concave to the north 105.70 feet, whose chord bears S89° 57'44"E, 86.37 feet, whose central angle is 123' 35'57" and a radius of 49.00 feet; thence 89"57'44"E, 176.94 feet to the Point of Beginning. The above described tract contains 0.8798 more or less acres. Pi be, and the same hereby is, vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered published this 20th day of August, A.D. 1985, and to be presented for final passage on the _Ird day of September, A.D. 1985.
