RE: Bennett Street
Enclosed is the proposed Utility Agreement between the Poudre School
District and the City relative to the completion of paving of Bennett Street
in front of Bennett School.
Both the School District and the City are desirous of completing the
installation of sidewalk, curb and gutter, and asphalt paving for safety and
dust control purposes.
The property on the north side of Bennett Street is presently undeveloped,
and the owner is not interested in contributing toward construction cost.
Since the School District has a budget limitation of $16,000 for the
completion of the street improvements, and the total cost of improvements is
approximately $20,000 (including asphalt and curb and gutter on the north side
of the street), we feel it 'is reasonable for the City to participate in the
construction cost up to$4000 to insure that the full street is completed at
this time.
At some future date when the property to the north develops, the City will
attempt to recover the cost of street improvements. The School District would
not be reimbursed from any funds recovered.

RE: Consider Approval of Agreement Between City and Poudre-R-1 School
District in Connection with Improvements onoBennett Street
The City has been working with the School District for some time to improve
Bennett Street. We have: been receiving a considerable number of complaints
with regards to dust in the area. Also, Bennett Street is a bikeway between
Shields Street and City Park. Bennett School is located on the south side
of the street. The property on the north side of the street is not subdivided
and apparently will not be subdivided or improved in the foreseeable future.
Both the School and the City would like to see the entire street improved
including curbs and gutters on both sides of the street. The City also required
the School to :replace some existing concrete drainage pans. Subject.to approval
of the City Council, we agreed to pay the difference between $16,000 and a sum
not to exceed $20,000. We have adequate funds in our street program.to pay for
our $4,000 share of the cost. If and when the property to the north.developes,
the City will :recover part of this cost from the benefitting property owner.
Bennett Street is not a dedicated street.at the present time. The 'School
Administration and School Board have given us all the necessary legal•papers
to dedicate a (50-foot street to the City of Fort Collins. When this dedication
is accepted and the improvements completed, the City will accept the street
for ownership and maintenance. To safeguard our potential future recovery
of improvement costs, we are accepting 59 feet for street purposes 'and one
foot as a quit claim deed.
Recommendation: The Administration recommends that the City Council approve
the aforementioned agreement and authorize the City Manager and City Clerk to
sign it on behalf of the City. The Administration further recommends- that the
City Council accept the dedication of the aforementioned street..

SUBJECT: Bennett. School Road Dedication Agreement
Please find enclosed the revised agreement submitted by the Poudre School
District No. R-1 relating to Bennett Road adjacent to Bennett School and the
utility plans for the Bennett School Road. The School District has added paragraph
seven to the original agreement drafted by the City Attorney.
In a conversation with Richard Graef, Director of Administrative Services
for the School District, it was pointed out by the City Staff, that the residence
at the northwest corner of Shields Street and Bennett Road has an existing access
on Bennett Road. It was recommended that this access remain and any financial
agreements be worked out between the owner and the School District for improvements
adjacent to this property.
The method of repayment as indicated in the revised agreement should not
be one-half of the total cost of all improvements. To be fair to all property
owners it would seem that they should pay only for those improvements adjacent
to their property from the Bennett Road centerline to their right-of-way line.
Richard Graef expressed his general acceptance of these recommendations and
asked that the City Attorney be contacted to rewrite paragraph seven to meet the
satisfaction of the City. Changes in the agreement should be forwarded to the
School District's Attorney, Ralph B. Harden, and any difficulties discussed with
him.
The School Board meets on the 27th of this month and the City has been requested
to have the agreement in a final state with necessary copies (3) to be signed at this
meeting.
