HomeMy WebLinkAboutSTONEHENGE PUD SIXTH - Filed EV-EASEMENT VACATION - 2004-11-08r 0 2 19Eh 12: 24 ORDINANCE NO. 101, 1984 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF STONEHENGE P.U.D., SIXTH FILING WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of an easement located in Stonehenge P.U.D., Sixth Filing, set forth in more particular below; and WHEREAS, the Vineyard at Stonehenge P.U.D, Filing One replatted a portion of the Stonehenge P.U.D. Fifth and Sixth Filings; and WHEREAS, right-of-way and lot locations on the remaining portions of the Stonehenge P.U.D., Fifth and Sixth Filings do not agree with those necessary to match up with the Vineyard Filing One plat; and WHEREAS, this vacation is needed to consolidate the remaining un- developed property under one filing and to replat the area to reconcile rights -of -way and site layout with existing filing; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of Stonehenge P.U.D., Sixth Filing set out more particularly as follows, to wit: A tract of land, located in the North 112 of Section 19, Township 7 North, Range 68 West of the 6th P.M., City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows: Considering the West line of the North 112 of said Section 19 as bearing N 00°00'00" W and with all bearings contained herein relative thereto: Commencing at the West 1/4 corner of said Section 19; thence N 89°49'30" E 50.00 feet to the southwest corner of Stonehenge P.U.D. Sixth Filing, on file with the Larimer County Clerk and Recorder in Book 1851, Page 80; thence N 89°49'30" E, 606.00 feet; thence N 00' 10'30" W, 155.00 feet; thence N 89°49'30" E, 55.95 feet; thence N 00°10'30" W, 60.00 feet; thence N 10°20'00" E, 93.00 feet; thence N 22°04'00" E, 0.84 feet, said point being the POINT OF BEGINNING. Thence N 58°00'00" W, 126.82 feet; thence 28.27 feet along the arc of a curve concave to the East, whose central angle is 90°00'00", radius of 18.00 feet and whose long chord bears N 13°00'00" W, 25.46 feet; thence N 32"00'00" E, 46.52 feet; thence 16.82 feet along the arc of a curve concave to the Southeast, whose central angle is 53°33'16", radius of 18.00 feet, and whose long chord bears N 58046'3B" E 16.22 feet; thence 32.56 feet along the arc of a reverse curve concave to the Northwest whose central angle is 40°33'16", radius of 46.00 feet, and whose long chord bears N 65016'38" E, 31.88 feet; thence N 45°00'00" E, 60.00 feet; thence 72.87 feet along the arc of a curve concave to the West whose central angle is 90°46'00", radius of 46.00 feet, and whose long chord bears N 00°23' 00" W, 65.49 feet; thence N 36°15'08"E, 47.03 feet; thence S 44°16'20" E, 52.25 feet; thence S 75°12'10" E, 54.75 feet; thence N 89°49'30" E, 60.00 feet; thence S 73' 52'23" E, 45.97 feet; thence S 89°49'30" E, 60.00 feet; thence S 73°52'23" E, 45.97 feet; thence S 89°49'30" W, 66.50 feet; S 55°54'00" W, 93.00 feet; thence S 22°04' 00" W, 197.16 feet to the POINT OF BEGINNING. The above described tract contains 0.691 acre, more or less. be, and the same hereby is, vacated, abated and abolished. ORDINANCE NO. 79 , 1980 OF THE COUNCIL OF THE CITY —OF FORT COLLINS VACATING EXISTING EASEMENTS IN THE STONEHENGE P.U.D. SIXTH FILING WHEREAS, the City Council has been petitioned to vacate existing easements as shown on the repl at of Lots 1 and 2 on Tract A of the repl at of Lots 40, 41, 42 and 43 and Tract C of the amended plat of Stonehenge P.U.D. Sixth Filing, more particularly described below; and WHEREAS„ said existing easements are not presently needed; and WHEREAS„ it appears that the rights and residents of the City of Fort Collins will in no way be prejudiced or injured by the vacation of said easements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following easements, more particularly described as follows, to -wit: A 6' utility easement 134.31' along the north boundary of Lot 40; A 15' utility easement 134.31' along the north boundary of Lot 41; A 24' maintenance access and utility easement 56' along the east boundary of Lot 40 and along the west boundary of Lot 41; A 20' maintenance access and utility easement 44' along the east boundary of Lot 40 and along the west boundary of Lot 41; be, and the same hereby are, abolished, vacated and abated.
