Colorado Re: manning subdivision On November Sth, I directed Flatiron Paving to cease grading work on University Avenue because the utility plans had not been approved by the City and a utility agreement had not been finalized between the City and the developer. I talked to Skip Jodoin of Flatiron later that day and told him that I would not allow any more work on this subdivision until the utility agreement was in order. The City of Fort Collins Codes and Ordinances Chapter 99 (subdivision of land) specifically states that - "No improvements shall be made until all required plans, profiles and specifications for the same have been suYmitted to and approved by the City Engineer." on or about November 7th, your company installed vertical curb and gutter on University Avenue for this subdivision in direct violation of this ordinance. Also the Engineering Inspection Department was not notified that you were performing this work. I called Jim Feidler of your company on November loth and informed him of these facts. Fortunately, the curb and gutter was not revised during City approval of these plans, however, there are underground utilities to install and I am concerned because the curb and gutter now in place might compromise this installation. There are four sewer services to install and the existing sewer main is ten feet deep. To insure adequate compaction of these deep trenches, I will direct the utility line contractor to remove curb and gutter at these crossings. F&F Concrete, Inc. November 14, 1980 There is a six inch diameter water main to be installed on University Avenue approximately four feet north of, and parallel to, the curb and gutter you installed. I have talked with the utility line contractor, and he believes that he can install this line without damaging your work. However, I will not hesitate to direct him to rerove any or all curb and gutter if I feel that it might endanger workmen in the trench by preventing a safe excavation. After the underground utilities are installed and accepted, your congpany will be required to replace the curb and gutter reroved or damaged at no expense to the utility line contractor, or to the City of Fort Collins. If you would be sure to notify the Engineering Inspection Department as required by Chapter 95 of City of Fort Collins Codes, I en sure that I can prevent such problems in the future. Collins, CO 80521 Re: Manning Subdivision Dear Ron: This letter is to recap our conversation of January 19, 1983, concerning the need for asphalt pavement on University Avenue adjacent to the Manning Subdivision. On this date I informed you that the subdivider of this project was not required to totally improve this street section until such time as his buildings are completed and ready for Certificates of Occupancy. The Code of the City of Fort Collins, Chapter 99, sets the criteria for development. In addition, each developer is required to sign a utility agreement with the City at the time of his subdivision approval. This agreement sets additional criteria for each particular subdivision. In reviewing the agreement for the Manning Subdivision, there is no time limit for street construction completion. Therefore, the City cannot require the developer to install the necessary asphalt pavement at this time. I have visited this particular site and do agree that there is a need for some type of material to be placed between the old asphalt edge and the new curb and gutter. This situation does pose a vehicular safety hazard. The developer will be contacted and informed that he needs to correct this problem. It must be noted that the material the developer elects to use may not be of the road base type. Again, the developer is not required to complete any improvements until such time as directed by the utility agreement or City Code.
