Paragraph 5c of that Agreement specifically provides, in part, that the developer understands and agrees that no building permit shall be issued for any structure within the subdivision prior to the written approval of the New Mercer Ditch Company for the discharge of storm run-off from the subdivision into the Ditch. I received from you a copy of an agreement between the New Mercer Ditch Companv and the owners of the Larkborough Subdivision which, in part, provides that, whether or not the ditch is eventually relocated, both parties agree that the owners of the Larkborough Subdivision shall construct a detention pond adequate to retain run-off water from the development, to permit no more water at no greater velocity of flow into the New Mercer Ditch than what presently discharges therein from the existing pipe under the railroad track. This provision would seem to satisfy the requirement of that portion of the Subdivision Improvement Agreement which requires the approval of the New Mercer Ditch Company for the discharge of the storm run-off. We cannot sign your letter as presented since, in fairness to you and the Callopy Estate, the time for such abandonment is not well defined. The City feels that it should reserve the dedicated right-of-way as shown on the plat for a period of ten years. If by January 1, 1990, the City has not seen cause to utilize the dedicated right-of-way for transportation purposes, we feel Art Builders and/or the Callon, Estate should request, in writing, that the City abandon said right- of-way and if approved, this property would revert to adjoining property in accordance with state statutes covering such abandonment. To the best of my knowledge the detention pond needs seeding, the placement of concrete trickle channels, rip -rap, and an engineer's certification that it is built per plan before the City will accept it. J�11 manholes and gate valves in Phase II are properly raised, but (` compaction tests need to be taken to verify necessary subgrade compaction around the six manholes that still need asphalt patching. ,The manholes and gate valves in Phase III need to be raised through the existing base course for accessibility. TL fire hydrant on the west side of Hummingbird adjacent to the i,,•C� drainage way needs to be straightened. Type III barricades as per specifications I gave you must be installed on both ends of Troutman Parkway and the west end of Larkbunting Drive. The existing curb cut providing access to the sales office from Harmony Road must be removed and replaced with standard 6" vertical curb and gutter. On Harmony Road, the curb, gutter and walk must be extended to the west property line, and the walk must be completed from Larkbunting to the east property line. For future reference, we are now requiring asphalt patching around all manholes and water boxes that are raised through asphalt pavement. The possibility of future abandonment of Troutman Parkway east of Tanager Street will not affect the certificate of occupancy for Lot 20, Block 1. The right-of-way itself, however, will not be abandoned until January 1, 1990, at the earliest. Please refer to Mauri Rupel's letter to Louie Hausman dated December 4, 1980. Dave Werner Page 2 Concerning the drainage way between Warbler Drive and Hummingbird Drive, at this time we are open to several courses of action to eliminate the problems associated with the steep side slopes particularly the house south of the ditch on the east side of Warbler. You mentioned utilizing the R.C.P. that was previously removed from Troutman Parkway, and leveling the channel. We will have to get together with Bob Smith or Marc Engemoen, the storm drainage engineers, to reach a decision. Please contact me if you feel something was omitted (or added) from this summary. We are very concerned about potential erosion in thisr=ei'�TiS �'SiS�y o maintain it in the future. When you and I met at the site some time ago, we agreed that the elevations and locations of the houses adjacent to the channel probably prevent you from obtaining an acceptable side -slope in the channel. I advised you to consult your engineer regarding rip -rap for these areas. I recently examined the rip -rap you installed and have some concerns. First of all, rather than excavating the slopes before placing the rock, you simply armored the existing slope. This constricts the channel in this section, and the configuration may hasten erosion immediately downstream. During our meeting at the site, I specifically stated that you should not place any rip -rap to further constrict the channel. In addition, you placed a considerable amount of small,_ washed rock on the remaining slopes. This rock is unstable and only aggravates the maintenance problem. Perhaps if I had been more specific originally, the problem might have been corrected by now. At any rate, the following corrective measures must be under- taken before the City can accept this channel for future maintenance. (1) The maximum allowable side slope for earth lined channels is 4 to 1. At any point in the channel where slopes are steeper than this, a slope treatment which will address both stability and maintenance concerns must be used. (2) In that portion of the channel where you have installed rip -rap, your engineer should verify that the constricted channel's capacity is adequate, and should evaluate it with respect to turbulence and additional erosion. (3) Any rip -rap you place must conform to the City standards regarding size, gradation, etc. (4) Before doing any additional work on this channel, your engineer mist submit a plan of the proposed improvements for our review and approval. This will prevent the installation of any more inadequate improvements. Frank Jones Ann Development Canpany Page Two I apologize for my delay in preparing this letter. Beginning at the lower end of the ditch, near the detention pond, the Engineer is to verify that the side -slopes are within the 3:1 maximum. If not, the Developer is to correct the situation to bring the slopes within the acceptable tolerance. That section of the ditch between Hummingbird and Warbler Drives is to have rip -rap placed to the rear of the houses of both streets. The rip - rap will be placed to conform to ditch geometries and well graded. A fabric or visqueen was recommended for weed control within the rip -rap. The remaining area of this section is to be graded to the maximum side -slope tolerance of 3:1. The ditch west of Warbler Drive to the west property line is to be finish graded and verified by the Engineer. It was agreed that the City would accept this portion of the ditch for City maintenance subject to construction activity for houses along Coldeneye Drive. M & I, Inc. will prepare a drawing of the ditch between Hummingbird and Warbler Drives indicating the limits of rip -rap and specifications for material and placement. Prior to your permaanent solution, you have agreed to provide a temporary DUMP to discharge vour subdrain at the surface to allow the subdrainage system an outlet to tail Creek and provide relief for the present subsoil saturation. Oak, Suite 513 Fort Collins, CO 80521 Dear Louis: This letter will summarize the conversation that took place on September 3, 1982, at the crossing of the New Mercer Ditch and Harmony Road. Present from the City were Roger E. Krempel, Robert Smith and Tom Hays. Present from the ditch company were Louis Swift, Shawn Hoff, Earl Stafford and Ron Ruff. The on -site meeting was called at the request of the ditch company to examine the grate structure on the ditch on the north side of Harmony Road. The ditch company's concerns as I understood them are the following: 1. The present grate structure is not being adequately maintained. 2. Inadequate maintenance impairs the operation of the ditch causing fluctuations in the water levels which has led to flooding. The City representatives made the following proposals to the ditch company to alleviate the problems. A. The City will provide a two-way radio to Shawn Hoff so that rapid communication with the City Street Department can be established when problems occur. B. The City will reconstruct the trash rack of sturdier materials and/or design an automatic cleaning rack similar to those in common use in wastewater treatment plants. C. The City will investigate alternative cleaning points to reduce the accumulation of trash at the present point. D. The City will clean the grate frequently, giving special attention to Friday afternoons and Monday mornings. Mr. Louis Swift September 8, 1982 Page Two It is the City's intent to implement these actions prior to the next irrigating season for items B and C, and to implement A and D as soon as possible. The City desires to cooperate fully with the ditch company to alleviate and avoid future problems to the stockholders of the ditch company. Kahler American Builders 300 Troutman Parkway Fort Collins, Colorado 80526 Re: Larkborough Subdivision Dear Roy: Recently, it has been brought to the attention of the City Engineer's office that extensive asphalt street deterioration is occurring on Goldeneye Drive adjacent to the new homes being constructed by American Builders in the Larkborough Subdivision. It is the City's opinion street failures are due primarily to excessive physical abuse during the home building phase of the development. Even though heavy equipment and some dirt and debris is expected during the home building phase, the City holds the developer responsible for the repair of any damages which may result from this construction. The sections of street in question are exhibiting areas of alligator cracking which does pose maintenance costs to the City. Therefore, we will not accept those portions of street which are presently in need of repair due to the home building activity. Please be informed that the City will not release certificates of occupancy for homes on Goldeneye Drive until such time as the necessary repairs have been completed or arrangements have been made which are acceptable to the City. Prior to the City accepting other alternatives the street surface is to be cleared of the accumulated dirt and debris. This will enable Construction Inspection to mark the limits and note the severity of the street failures. After the repair areas have been identified, we will then be able to discuss with you an acceptable type or types of repair based upon square footage of surface area repair and severity of damage. I am recommending to the Storm Drainage Board that the improvements which are outlined in the report be installed to help reduce the problems which you, Mike, and several other homeowners in the area are concerned about. At this point I cannot say when or if the improvements will be installed since there are currently no available funds to finance this project. The next Storm Drainage Board meeting will be on November 9th at 7:00 A.M. in the C.I.C. Room at City Hall. (The C.I.C. Room is on the main floor of the new City hall.) At that meeting the Lark -borough channel will be discussed. You and the other homeowners in your neighborhood are welcome to come to the meeting and express your own concerns about the drainage problems in the channel. I will not be able to attend the meeting so if you have any questions about the report or the meeting, please call Bob Smith or Mick Mercer. Also, please feel free to make comments on the report and when I get back from vacation I will be happy to sit down and talk with you about my recommendations. Inlet on Warbler is undersized. c. Channel stabilization is ineffective between Warbler and Hummingbird. The channel east of Hummingbird should also be looked at. d. This subdivision was designed by M&I in 1978 and developed by American Builders. Although the drainage system has been accepted for maintenance by the City, it has not performed adequately. Four major problems which need to be corrected are: 1. Culverts under Hummingbird Drive are undersized. 2. Inlet on Warbler Drive is undersized. 3. Channel stabilization is ineffective between Warbler and Hummingbird. The channel east of Hummingbird should also be looked at. 4. The capacity of the channel has been reduced. M & I Engineering served as the design engineer with regard to this subdivision. Recently, the City Engineering Department brought to my attention certain inadequacies with regard to the storm drainage system for the Larkborough Subdivision. Essentially, there are four major inadequacies which must be promptly corrected by either or both of you with regard to this subdivision. They are as follows: 1. The storm drainage culverts under Hummingbird Drive are under- sized and must be enlarged. 2. The inlet on Warbler Drive is undersized and must be enlarged. 3. The channel stabilization between Warbler Drive and Hummingbird Drive is ineffective and additional rip -rap or other stabilization is necessary in order to insure the viability of this channel. Also, the channel to the East of Hummingbird should be examined for the same purpose. 4. Because of various design inadequacies, the capacity of this channel has been reduced and must be increased. I'm sure that you can understand that the City's review of the plans which were submitted by the developer, and prepared by M & I, is a conceptual review only and that the City's Engineering Staff relies upon the developer's engineer with regard to the overall adequacy of the design of the system. Accordingly, I would request that a proposed plan and work schedule be submitted to me within thirty (30) days of the date hereof. Fox R, Associates originally designed an underdrain system to dewater- the pro- posed !arkKqrcuqh Subdivisionfor b.o st snt construction „ mb� 1978. q the course of our investigation work, we had designed the, system under the assump- tion that that the City of Fort Collins would provide a positive discharge for the constructed underdrain system from the east side of Larkborough Subdivision through the railroad tracks to the east with the proposed trunk sewer- service that was to serve: as the sewer outfall for both Larkborough and the Woodlands. In addition, it was assumed that the water discharged through the drain system would be collected by the City of Fort Collins for the irrigation of a proposed park to be located east of the site. These assumptions were made on the basis of information supplied by Mr. Jim Collins of Art Builders, Inc., and Mr. Lloyd McLaughlin of M & I Consulting Engineers for subsequent planning in the overall sanitary sever plans for the pro- posed subdivision. During the construction of this underdrain, the assumption was still made that the connection would be provided to outfall the underdrain system with the installation of the sewer line to the east. It should be pointed out that the sewer line and underdrain had been constructed prior to connection with the sewer line which was provided by the City of Fort Collins. ALBUOUEROUE • DENVER • PHOENIX Mr. Mauri Rupel January 8, 1980 Page Two In Julv, 1979, we were contacted by Wood Brothers Homes and Art Builders, Inc., to determine the feasibility of connecting a proposed underdrain from Woodlands Sub- division to outfall through the previously constructed underdrain in Larkborough Subdivision. The basis on which we made our design recommendation and calculations are summarized in a letter to Wood Brothers Homes dated July 27, 1979. We based our recommendation that it was feasible to connect the underdrain and outfall of the Woodlands to that of Larkborouqh on the assumption that the City of Fort Collins would provide a discharge to the overall underdrain system with the construction of the service line to the subdivision. Durina the course of our investigation and sub- sequent to it, we were contacted by M R, I Consulting Engineers regarding the proposed outfall. We received information that the outfall had been deleted for the underdrain through the railroad truck embankment after the tie in of the Woodlands underdrain. This necessitated an alternate discharge to the overall underdrain system which was then investigated by M & I. M & I located an existinq 12 inch underdrain which paral- leled the east boundary of Larkborough along Merger Ditch and discharged into Mail Creek to the south. It was decided at that point in time to connect the Larkborough underdrain system to the existing 12 inch line. However the invert elevation of the existing underdrain was 3 feet below the invert elevation of the 12 inch line. This necessitated the creation of at least: 3 feet of head so that the Larkborough under - drain would discharge into the 12 inch line. Durinq the final construction of the underdrain in the northern portion of Larkborough Subdivision, excessive amounts of water had to be pumped from sewer excavations due to the increased flow of water com- inq from both the southern portion of Larkborough and that discharge from the Wood- lands Subdivision. In order to decrease the amount of water that was being pumped in the underdrain sys- tem of Larkborough, a blockage was constructed to terminate the discharge of the Wood- lands underdrain through the Larkborough system. This created, as reported by the City of Fort Collins, a condition where a build up of water ws occurring just to the western boundary of Larkborouqh in the Woodlands underdrain system. Saturation of the subgrade with subsequent seepage of ground water out on top of the ground surface just to the west of Lark -Bunting Drive was noted by city inspectors. On January 3, 1980„ a joint meeting was held between Wood Brothers, Art Builders, and the City of Fort Collins with F.M. Fox & Associates and M & I being represented. As stated by F.M. Fox at the meeting, the design criteria which was used to formulate the feasibility of connectina both systems was based on the fact that the City of Fort Collins was to have provided a positive gravity outfall for the systems. Since it was not installed, the only feasible method of continuing the Woodlands underdrain system through the existing Larkborouqh system, was to either provide a positive gra- vity discharge from the Larkborough Subdivision with the 12 inch line, or continue that underdrain out through the railroad tracks by the City of Fort Collins. The other alternative to this discharge of the Woodlands, was to provide a separate discharge line runninq to the south along the eastern property line of Woodlands Subdivision with either a positive gravity discharge to Mail Creek or the installation of a lift station to an existing detention pond with subsequent discharge. Additonally, the cost associated with providing a positive gravity outfall for the Larkborough Subdi- vision, as pointed out by Mr. Art Hansman, compared to that for providing a positive Mr. Mauri Rupel January 8, 1980 Page Three positive discharae for the Woodlands, showed a significant cost differential and at this time, it was decided that an alternate system, as described above, for the Woodlands Subdivision would be pursued by Wood Brothers Homes, Inc. We are available for consultation in the design of the proposed outfall to Wood Bro- thers Homes concerning design criteria, calculated flow volumes, etc. Please call should further consultation be required.
