There is apparently some misunderstanding as to what legal papers the City requires and what additional steps are necessary to complete your anne_xatton and sewer connection program with the City of Fort Collins. 1 suggest that Roy Bingman and Bill Kane, City planner, meet with you to go over the details of the City's requirements. Hopefully at that time you can rrach a mutuaLly agreeable understanding. Brunton. I do recall the conversation you made reference to in Mr, Brunton's office 1:.,hen the City agreed it .could provide the annexation plat as it later did; however, I feel this has no reference to your previous agreement to provide a subdivision plat and unit development plan. At the time you applied for the sewer tap, you signed a letter in which you expressly agreed to provide a subdivision plat and unit development plan. The letter further stated that if you failed to do t:ie things you had agreed in the letter, the seller service could be termi-ated. At the time 1•:e met in `;r. Brunton's office we were concerned only i:ith the question of converting; to City electric service and the CitY's charges 'which i•;ere glade in connection with such conversion and the :utter of providing the annexation plat. :'here was no discussion at that time about the clatters on which you had already agrcci:, alld al:' COM-ProilL se was onily on the ..utters than In dispute. Because of this, it appears to me beyond question that you do have an obligation to furnish these t1<o items to the City and I would request that they be furnished as soon as possible. Box 506 Fort Collins, Colorado 80521 Dear Mr. Wilmarth; Your letter of December 3, 1973 requesting traffic signals at South College Avenue and Horsetooth was brought to the attention of the transportation committee on December 12, 1973. Since the location in question is partially in the city limits, as you mentioned, this will have to be a joint effort with the City and the State Highway Department. I have been in contact with Mr. Marvin ,tiller, Safety Engineer for District 4 of the Highway Department, and we will be making an investigation of the intersection as soon after the first of the year as weather permits. Mr. Miller stated that a study of the intersection had been made some 10 months ago. At that time there was not sufficient evidence to warrant signalization. However, with the opening of the shopping r,.all and other businesses in the area and the added development on Horsetooth to the east it is felt that the traffic patterns have changed considerably. Mr. Miller and I will be working closely on the investigation and I will personnally inform you of the results of the investigation as soon as they are available. Sincerely yours, Joe A. Wilmarth: I am writing again in reyard to the Horsetooth Lanes property at 217 West hiorsetooth Road. Mr. Arthur March, City Attorney spoke to you some time ago concerning the connection of the property to the City sewer system, and the City requirement for subdivision plat, unit development plan, and street dedication. To date we have received no indication that you intend to comply with the City requirements specified at the time of connection to the sewer system. We must therefore inform you that we will disconnect this property from the City sewer as of Mlarch 15, 1974 if the r,,quested items are not provided to the City. Sincerely, Vl Roy A. Horsetooth Road we are in receipt of your letter of February 14, 1974. Apparently the lack of communication between City personnel is as bad as ever. We have no unit development plan, as we previously indicated, just one building on one lot. We have no subdivision plat, just one builing on one lot, which was alreadv erected when annexed. We have previously submitted a survey o-' the lot showing the lot dimensions. No one has stated what street dedication is necessary, and we will be glad to meet to review this point to the extent necessary. Tf you disconnect the sewer, in our opinion, you will be in violation of your own ordinances, and perhaps, several state statutes, if you do so for the reasons giver. in your letter of February 14, 1974.
