We would like to suggest a meeting with you, Bob Lee, Roy Bingman, Lucia Liley, and any other city staff you feel appropriate to discuss the following items: 1) A new westerly alignment, of Lemay Avenue between Lincoln and Vine, and the acquisition of additional right-of-way along our property frontage. 21 The scope of improvements to Lemay and the timing of such improvements. 3) Location and installation of utilities in the revised right-of-way, particularly the planned 24" water line. 41 The timing and responsibility for utilities and improvements. 5) Possible reclassification and realignment of Buckingham: Street. 5) A procedure for wakiny the necessary revisions to our plat and engineering specifications to accomodate the realignment of Lemay, plus other minor changes that we have discussed with you previously. These changes would include reduction of the pavement width on Logan Court, increased cul-de-sac width, installation of landscaped medians, placement of drainage catch basins, phasinq of our water system loop, and placement and phasing of sidewalks. 7) begotiation of right-of-way acquisition with the owners of Lots 3 and 4 to the south of our property. Our first reaction was to use the oversizing fund until the North Lemay Extension funds became free, then reimburse the oversizing fund. However, after discussing this with Phyllis Griep, we learned that the Prospect Underpass Project has been delayed and those funds might be available for transfer, since both the Prospect Underpass and Lemay right-of-way purchase are Capital Projects. Phyllis felt that this was the proper approach. Your approval of this action memo will suffice for her direction to proceed on this basis. The total purchase price is $11,344.00 for R.O.W. plus approximately $90.00 for closing. After researching the matter, it is the conclusion of the City Attorrey's Office that the ordinance car be applied to all outstanding plats if the public improvements in the right-of-way have not occurred. In the case of the North Lemay Subdivision, there has been no significant development activity and therefore the right to proceed under the plat has expired. P.efore any further development of the site, the owner will be required to resubmit plans for approval accord- ing to the processing requirements for new plans. The effect of this is two -fold: (1) The riaht to develop is considered to he forfeited, although the dedications remain effective, and (2) all obligations of the City may be considered to have ceased. The City is in the process of notifying all property owners of plats, which were approved prior to the enactment of this provision (April 13, 1984) in which no significant development activity has taken place, of this action. Apparent:'_y, Mr. Zdenek is in the process of resubdividing the area, and wants to know what the City Needs for additional right-of-way for the completion of I.emay Avenue. We told Mr. Zdenek that: • we would identify the amount of R.O.W. that we would need if Lenay remains on the Dresent alignment. • that provision for acquisition of the R.O.W. would be included in the subdivision agreement. • that you would work with Zolenek and Muenzberg to see if an agreeable property valuation could be worked out. Krempel, P.E., Director of Public Works & Water Utilities RE North Lemay Subdivision And Arterial Alternatives ISSUE The developers of the North Lemay Subdivision are requesting approval of the replatting of the subdivision, which includes an additional right-of- way dedication for the future alignment of North Lemay Avenue in the Andersonville-Alta Vista area. The developers are requesting that the City pay fer the additional 20 foot of right-of-way dedication above that sho:•m on the original plat. The approved 1981 budget does not include an appropriation or sufficient funds to pay for the additional right-of-way. BACKGROUND The North Lemay Subdivision was originally platted in 1974; the plat included a dedication for development of Lemay Avenue as an arterial street of 50 feet in width for the west one-half. Since that time the Lemay Avenue Bridge and Extension have been constructed, which increased traffic substantially. Planning for North Lemay Avenue included identification of an alternate easterly alignment in order to eliminate the impacts of the arterial street on the Andersonville-Alta Vista neighborhoods. The question requires considerable further analysis, a public hearing and a recommendation before consideration and a decision by City Council. This analysis should proceed following the determination of the final alignment of the Fort Collins Parkway. This will happen within about t,,lo years. Attached is a sketch that shows the possible alternative alignments. As shown on the cross section the westerly alignment provides for the arterial road:•;ay to be separated from a frontage road serving the adjacent property. The options available are the following: 1. Include the funding for the R.O.W. acquisition in the budget submitted for 1982, which would permit final acquisition in January, 1982 if the item is included in the budget. 2. Use funds which may be available later in 1981, if the other projects have excess funding; staff will be able to ascertain whether this amount is available in Fall, 1981. 3. Use funding available in the contingency account of the C.M.; the amount necessary for the purchase is $ 11,344.00 . If available this would permit acquisition of the R.O.W. promptly.
