The revised preliminary plan is substantially the same in terms of drainage impact as the previously approved preliminary PUD and drainage study. We, therefore, do not believe it is necessary to modify the previously approved preliminary drainage plan at this time. Tejon Street Denver, CO 80223 Dear Mike; The City of Fort Collins Engineering Services will release the Footing and Foundation Permit for the proposed convenient store on the northwest corner of Shields Street and Horsetooth Road without the completion of all the utilities, provided the Developer has met the three conditions as specified in the Development Agreement for The Market at Horsetooth Commons P.U.D., and is restated below: E. Footing and 'Foundation permit. Prior to the issuance of the footing and foundation permit for any buildings within this Development, the Developer agrees to the following: (i) No combustible material will be allowed on the site until the water system is installed by the Developer and approved by the City. (ii)To provide and maintain an adequate all-weather roadway access to any building under construction, to handle any emergency vehicles or equipment. Such access shall be at a minimum, 20 feet wide roadway of 4" base course material compacted according to City Standards, with a 40' radius turnaround at each building and dead end. (iii)The issuance of said footing and foundation permit is solely at the Developer's own risk and the Developer shall hold the City harmless in the event of any damages result- ing from the issuance of said permit prior to the comple- tion of the requirements in accordance with the Code of the 300 LaPcrte Ave. • PO. The required utilities are all util- ities as specified in Chapter 99-6. B. in the City Code serving such build- ing which is the subject of the Building Permit, and are shown on the approved utilities plans.
