It is my understanding that an additional provision to the Standard City Development Agreement was added by the attorneys' for the owners and that the City is now requesting indication that the Purchaser, Osprey, Inc., consents to the additional provision. I can, on behalf of the applicant Osprey, Inc., state that the applicant does so consent to the addition of that provision and will, upon presentation, indicate its acceptance by initialing the additional provision. Dear Tom: It has come to my attention that during construction of the sanitary sewer by Loveland Excavating the sidewalk, which is part of the South Lemay Improvement District, was damaged by heavy equipment traffic. This area is at the northwest corner of the intersection of South Lemay Avenue and Harbor Walk Drive. Kennedy Parkway Fort Collins, Colorado 80525 Attn: Mr. Walt Barclay Dear Wait: Per your request, vie have reviewed the elevations of the existing overlot grading at Harborwalk Estates. It is our opinion that the completed overlot grading is generally in accordance with the approved grading plan. Confirmation was based on 31 spot elevations surveyed on June 19, 1967. The results of this check are as follows: Locations where current elevations are equal to = 3 design elevations. Locations where current elevations are greater = 19 than design elevations, ie. more fill than required; variance = 0.1' - 2.1' Locations where current elevations are less = 9 than design elevations, ie. less filled than required; variance = 0.1' - 1.4' The areas, where fill is less than required, are minimal for the most part and in the lower range of t1Te variance. A map showing locations and elevations is available for ,your review. It is noteo that the grading plah is an overlot grading plan and is not intended to reflect exact finish grading after building constriction. Material from building excavation is to be used in canpletion of the finish lot- grading. T'_ds .is dependent on the size of home on each lot, and the type of house design incorporated. The completed hares on the project are reprr,sentative of the actual finish grading of the lots.
