In speaking with Tim Buchanan (City Forester), he suggested some specific details for ensuring the survival of these trees when College is further widened sometime in the future: They should be planted approximately 3.5' from the back of the sidewalk, and planted high (a few inches), and the fill should be a sandy loam rather than a clay-ey soil if possible. Please provide this detail on the landscape and grading plans, and if you have any questions, feel free to contact Tim at 221-6361. For the southern four trees, please provide $ for these to be planted in the future. This will be covered in the Development Agreement. The A.D. should always be provided, and is needed to check the K value and to determine the minimum vertical curve length according to LCUASS Figure 7-17. With an AD=1, and design speed of 55mpy, the minum curve length according to the graph is approximately 240 feet. The vertical curve currently designed is only 160' long and has a K=1001 when the minimum K for a crest curve on an arterial is 110. If these standards cannot be met, then please submit a variance request according to LCUASS 1.9.4 for consideration. The street's stormwater capacity may be used as a justification, if applicable. Issue Contact: Glen Schlueter Topic: General Number: 220 [2/23/04] Discount Tire 2-23-04 Created: 2/23/2004 The City of Fort Collins learned this week that some of the floodplain modeling in the vicinity of your site may be incorrect. The irrigation check structure in Fossil Creek is 1.f ft. higher than previously thought. It is expected that this will raise the flood elevation on this site, but it is not known by how much. We will not require Discount Tire to change their building elevation. However, we want Discount Tire to be aware of this issue and they may want to consider raising their building to give themselves additional freeboard in order to protect the building from flood damages. This information was found when the City's Parks department was doing survey work for the future trail. Stormwater will be working with the Parks department over the next several months to revise the floodplain modeling and also see if there is any mitigation that can take place as part of the trail design. No. 224 - I again went to Latimer County to get the reception number per your request and they could not find it. However, since it went to Council and is of City Record it's not required that I know of to be recorded in the County, but it should have been. I can do no more for the cause. See notes on sheet two of two for Council ordinance number and that defines that it has been done. The Fossil Creek floodplain is a no -rise floodplain. Any development taking place outside of the erosion buffer limit but within the 100-year floodplain must show through hydraulic analysis that there is not a rise in water -surface elevation. A copy of the City's floodplain modeling guidelines are included. It's difficult to see where new and existing contours tie in. 37 Will the proposed retaining walls leave enough room for utilities to use the easement? What materials are being used to construct the walls? If the western wall is to be constructed at a later time, this needs to be clearly shown on all plans, and an interim grading plan should be included. That includes a minimum 3-foot clearance around the columns shown. A 5-foot clear zone width is strongly recommended by the ADA for safe passing and by the City since this is the primary connecting walkway to the business from the public sidewalk. There are inaccuracies within the Transportation Impact Study's pedestrian LOS analysis; in order to achieve the pedestrian LOS reported in the TIS the following improvements are necessary. The length of the street crossing of both Fossil Creek Blvd. and College Ave. require the construction of a pedestrian refuge according to the LCUASS. However, due to existing constraints on College Ave. a pedestrian refuge will not be required at this time. But please design and construct the pedestrian refuge for the Fossil Creek Blvd. crossing through the existing median for the next submittal. The sidewalk will also have to be extended slightly to the north in order to connect to the College Ave. sidewalk north of the Fossil Creek Blvd. street crossing. Such changes in massing shall be related to entrances, the integral structure and / or the organization of interior spaces and activities and not merely for cosmetic effect. This will require the north and south fa4ade to have projecting or recessing elements. See the redlined elevations. (9/25/02) Although revisions were made to the building design to address this comment, the standard is still not satisfied. Perhaps if the pilasters on the north and south elevations protruded more, this standard could be satisfied. As shown, the pilasters are only a cosmetic effect. See redlines. Following an October 10, 2002 meeting with Troy Jones. it was agreed upon that the current building design, modified to further accentuate the pilasters on the north and south elevations, met the "variation in massing" requirement. Revised drawings dated 1 1/1 V02 and accompanying renderings reflect this change. 82 (6/25/02) Provide a material board including color samples. I'm wanting to ensure the colors with the neighborhood as required in 3.5.1(F) of the LUC. Specifically, "banner red," "burgundy," and "main harbor" are extremely difficult to estimate without a sample. (9/25/02) Repeat comment. Although the color computer rendering is helpful, actual samples of the colors are still necessary. A color and materials sample board accompanies the current submittal package. 100 (6/26/02) Be sure that the glass on the storefront specifies clear glass rather than reflective glass as required in Section 3.5.1(e)(3) of the LUC. (9/25/02) In addition to material note#5, label the glass on the elevations as "clear" Revised drawings dated 11/13/02 indicate "clear glazing in all aluminum storefront openings. 160 What all does the screen wall on the north side of the building screen? Are all IIVAC equipment and utility meters located behind this screen wall. Please clarify. The material of the screen wall cannot be "different from or inferior to the principal materials of the building" as stated in Section 3.5.1(1)(2) of the LUC. This screen wall must be made of the same CMU blocks as the building wall. Due to the hip configured metal roof, a split -system H.V.A.C. system will be proposed for this building. The condenser units( 3 of them) will sit on grade, in this location and will be screened by this wall. Per the revised elevations, dated 11/13/02, this screen wall will he constructed of materials to match the building materials. 161 The wall pack lights are labeled correctly on the elevations, however the color perspective rendering shows wall packs that are not down -directional. The wall mounted fixtures, as shown on the building elevations. dated 1 1/1 1/02, will be a type that are shielded. down -directional. Topic: General 65 (9/25/02) Please include a general note on the site plan that explains that the 42 spaces would Normally be the maximum parking allowed but because on -street and shared parking is not available for the site, and the amount of parking lot landscaping provided exceeds the minimum amount required by more than 20%, the 46 spaces provided are permitted in accordance with section 3.2.2(K)(2)(a) of the Land Use Code. A general note has been added to the Site Plan explaining the 42 spaces as outlined above. 99 (9/25/02) Transportation planning is still not satisfied with the sidewalk connection between the building and the future Fossil Creek Trail. Please involve Transportation Planning and the Current Planning in discussions of a proposed solution. A meeting was held on 10/10/02 with City staff members including Tom Reiff from Transportation Planning and Cun-cnt Planning (see attached memo which was sent to all City staff members dated 10/15/02). At the meeting it was determined that an additional Public Trial Access Easement space will be given to allow for the connection from the South College sidewalk to the proposed trail. 162 The trail easement provided on the plat must also be shown on the site and landscape plans. Clarify how the 20 foot trail easement is supported to allow a future trail to tit in an area that is the sloped bank of the detention pond ( in the east corner of the site). This should be coordinated with Park Planning, Current Planning, Transportation Planning, Engineering and Stormwater Departments. The trail casement is shown on the Site and Landscape Plans. The storm drainage configuration has been changed and this comment no longer applies. 163 The College Avenue improvements appear to still be somewhat up in the air. Between utility coordination, utility easements, right turn lane issues, sidewalk needs, and the trail connection needs, there needs to be additional coordination for this western edge of the site. A coordination meeting was held on 10/3/03 with Engineering — Katie Moore and Dave Strinoer, Traffic Operations — Eric Brake, Stewart and Associates — Michael Randolph and VF Riplcy Associates — Louise Herbert. College Avenue improvements and the trcatmerit of the western edge of the site where discussed and coordinated. For this project, the existing curb and gutter will he removed and replaced to provide additional roadway width lot- the striping of a northbound bike lane. The existing right turn lane did not provide the required width. Moving the curb and gutter required the under -rounding of the existing PVREA facilities located in the ROW. Katie Moore arranged a Utility Coordination meeting, and Michael Randolph outlined the project to all utilities involved. Most existing utilities are underground and not affected by this project. Light and Power. and Q-west will locate their utilities in the future 10' Parkway area. At&T will share a trench with either L&P or Q-West. The sidewalk will be placed in the Ultimate position, except for the ramp to the intersection of College and Fossil Creek Parkway. Due to the difference in alignment between our interim design, and the final design for a 6-lane arterial, the sidewalk ramp will need to he removed and replaced upon expansion. The traffic facilities conflict with the Ultimate design and will need to be moved. The proposed interim sidewalk allows for connection to the Future Fossil Creek Regional Trail, but does not extend to the Southern edge of the site. Additional public trail access casement space has been provided to connect to this placement. The shortening of the walk is due to the difference in grades between the existing conditions on College and the grades required for the Ultimate design. There is no way for a pedestrian utilizing the proposed sidewalk to cross Fossil Creek without walking in the shoulder of Northbound College. This has been discussed and agreed to by Matt Baker of FC Street Oversizing. Discount Tire will provide escrow money for the remainder of sidewalk and fill material require at construction of the Ultimate design. 164 Are there any outdoor displays of new tires? If so, show where. This may be a flood plain issue, so locate them out of the tloodplain. If not, specify in a general note on the Site Plan that no such exterior new tire displays are part of this approval. Therc will be no outdoor lire displays. See note number 13 under the General notes on the Site Plan. 165 This project has an extraordinary amount of repeat Engineering and Stormwater Comments. It is our staff's perception that the progress of the review of the project is getting hung up because your engineering consultants aren't addressing many kev comments from the first round of review. Acknowlcd<-ed. Topic: Landscape Plan 78 (9/25/02) In locations where the existing water line does not conflict with street trees being located in the parkway strip, put them in the parkway strip. In locations where the existing water line precludes this placement, behind the sidewalk is fine. The street trees have been adjusted as requested above and per the redline Landscape Plan. 94 (9/25/02) "Full tree stocking". Repeat comment. See latest landscape plan from Current Planning. The Landscape Plan has been revised as per the redline plan to comply with this standard using deciduous and ornamental trees against the building. 97 Planting note number 2 should also clarify that if a street tree is an ornamental tree, it need only be separated 15 feet from a street light. A note has been added to the Landscape Plan in the plant notes. 98 (6/26/)2) Plant note number 18 specifies Kentucky Blue Grass. Fescue is a preferred turf species because it uses less water. Section 3.2.1(E)(3)© specifies that landscaping plans incorporate "low-water demanding plants and turf where practicable". A good majority of the site is within the buffer area and is native seed and plantings. Plantings elsewhere incorporate drought tolerant plants. Areas of higher watering turf' have been minimized as much as possible on the site. Either Kentucky Blue Grass or Fine Fescue can he used depending on the specific turf type and it's drought survival and drought tolerance qualities. Irrigation will be kept to a minimum as much as possible. Topic: Lighting 88 (6/26/02) Please double check the accuracy of the lighting on the photometric plan. Directly under the "LW" type fixture, a 400 watt metal halide fixture is only showing a reading of 5.0 foot-candles. Directly under the double head "tlw" type fixture, two 4011 watt metal halide fixtures are only showing a reading of 8.7 and 9.3 foot-candles. Is this accurate? It seems that perhaps foot-candles are not the unit of measurement being used. Please clarify the unit of measurement, and make sure that "foot-candle" is that unit of measurement. A revised site photometric layout is attached to the current submittal package. It contains Lighting and trees. The canopy trees in the central parking islands have been changed to ornamental trees to allow the requires spacing between lighting. This was discussed and agreed with at a meeting with Troy Jones 10/15/02 (see attached memo dated 10/t5/02). Topic: Transportation 89 Future Fossil Creek Trail - meeting with Transportation. A meeting was held on 10/10/02 with all the City staff members (sec attached memo sent to all City staff dated 10/15/02). At the meeting it was determined that an additional Public Trail Easement space will be given to allow for the connection from the South College sidewalk to the proposed trail. Department: Engineering Issue Contact: Katie Moore Topic: Detail Sheet - Utility 137 Please remove Drawings 8,7-30, and 7-33. Since no public street — public street intersections are being designed with this project, they are not needed. The entrance drive to Fossil Creek Parkway has been designed for this project. City Street Improvements and TST Engineering were helpful in getting this entrance built with the Fossil Creek Improvements so the detail is unnecessary and has been removed. 138 Please include the directional ramp detail and sidewalk detail. This has been added. Topics: General 1 Please submit a design for the right-hand turn lane on College. Please clearly show existing edge of pavement, existing ROW, proposed ROW, centerline of College, striping, section line, etc. according to LCUASS standards. Please show all existing data in a different line weight than the proposed features. This project will be required to provide an ultimate horizontal design for three through lanes, a bicycle lane, and a right turn lane on College, as well as designing and building, at this time, a 6' bicycle lane between the through lane and right turn lanes on College. Also required at this time will be the Ultimate placement of the sidewalk along College and access ramps on the Southeast corner of College and Fossil Creek. Any work on College must meet CDOT standards. All existing and proposed features are included in the plans. The Ultimate design information has hcen placed on a separate sheet to avoid confusion. The ultimate dcsivn has already been approved by the engineering department to assure that the ROW line is sufficient. Striping on college will be to LCUASS standards and detail's have been included. 2 Please match the site, landscape, plat, and utility plans. The ROW vacation shown on separate vacation request does not match what is shown on the plat and utility plans. All plans have been coordinated. 16 Please see redlines for additional comments. The TIS is an intermediate level TIS as described in Section 4.2.3 (C) of LUCASS and is appropriate based on the trip generation of the project. 3 The TIS is "silent' on alternative modes analysis and needs to be revised to include alt. modes. 4. The northbound right turn lane on US287 at Fossil Creek Parkway needs to be constructed in accordance with the State Highway Access Code. 5. Site Distance at the Fossil Creek Parkway entrance needs to be maintained. I would like to see a copy of the landscape plan and the location of landscape material in the existing parkway of Fossil Creek. 6. No auxiliary lanes will be required on Fossil Creek Parkway. This exceeds City Standard, however, the landscape island provides the pedestrian with protection from both EaSthOUnd and Westbound traffic on FCP and left -turning vehicles on Collcoe Ave. This protection creates unprotected cross�N alk distances of 55' and 40' North and South of the island respectively. At this point the sidewalk to the North does not exist. 157 Any Engineering comments lower in number than 38 are repeat comments. Acknowledged 158 The request for Vacation of ROW along College has been re-routed, and several comments still exist: Dennis Greenwalt of AT&T Broadband is concerned that his facilities may not be located in a utility easement after the ROW vacation is complete. He requested that these facilities be located and that he should be contacted again for approval. Utility locates were called for and all existing utilities were found to be within the proposed ROW expansion. At the utility confirmation meeting called for this project, attended by PVREA, FC Light & Power, Excel Energy, Qwest, AT&T. MCI WorldCom, FC Engineering, and FC Stormwater, no objections were raised to the project. (see response to Cun-ent Planning General comment 163) 159 Because the Ultimate grades and horizontal placement of the right turn lane are unclear, the documents showing the retaining wall placement within the utility easement were not routed at this time. This routing will have to take place at a later submittal. The current retaining wall design does not interfere with access to the utility easement. The proposed grading does except water from the Parkway and sidewalk areas. Through discussion with Wes Lemarque with FC Stormwater, the design provides sufficient draina-c and conveyance to provide safety from any major storm. Specific grades and cross -sections have been provided in an effort to minimize confusion and ensure compliance at time of certification. Topic: Grading Plan 33 Please grey out lines showing existing features. Due to the three different conditions along College (existing, interim, Ultimate) there is a lot of line work at the Western edge of the site. Separate sheets have been generated for the ultimate and interim designs in an effort to clearly convey the interim design. All existing features have been ' greyed out." 37 Will the proposed retaining walls leave enough room for utilities to use the casement? What are materials are being used to construct the walls' If the western wall is to be constructed at a later time, this needs to be clearly shown on all plans, and the interim grading plan should be included. Any retaining walls needed for the ultimate buildout of College are the responsibility of this development. (Sec Responsc to Engineering General comment 159) Retaining wall design satisfies all criteria of ultimate design. No future alteration is rcquircd for ultimate buildout. 135 It does not appear that the new grade lines along the Northern edge of the property tie into the existing grade lines. The existing asphalt and curb and gutter constructed by the Fossil Creek Improvements will not be effected. Contour lines have been altered to reflect this. 136 There is still a small amount of grading shown offsite. Please confine within the project's property boundaries or provide an offsite easement for the grading. No offsite grading was ever intended. The current proposed plan places the Limit of Development no closer than 30' from the Southern property line. This allows for full access to the existing SFCSD sewer easement, and provides a buffer for the future Fossil Crcek Regional Trial. An off -site easement will be required for the Detention Pond outf all. (See Response to Engineering Overall Utility Plan comment 32) 155 It appears that; the grading shown in the trail easement will not accommodate a trail. Please re -grade so that a trail may be constructed in this easement to ADA Standards. (See Response to Current Planning General comment 162) Topic: Landscape Plan All items listed were addressed in the last VF Ripley Associates response letter dated 8/27/02. Reponses are repeated below. 12 Please clearly label and dimension all ROW. This applies to the Site plan as well. The ROW varies on Fossil Creek Parkway. A dimension line is shown with a label "varies". This was discussed and confirmed by Katie Moore on 8/22/02. 13 Please make sure the sight distance easement line more prominent and label the area as a sight distance easement, adding the restriction language to this sheet (attached to the plat). The sight distance line has been made more prominent and the sight distance casement is shown on the Site and Landscape Plans. Sight distance easement language is shown on both the Site and Landscape Plans. 14 It looks as though many of the trees in the parkway along Fossil Creek, and in other areas, are not meeting utility separation requirements. The street trees in the parkway along Fossil Creek Parkway have been relocated to meet the required separation requirements. Topic: Overall Utility Plan 25 Please label the retaining walls. (See response to Engineering General comment 159) 29 Please label curb return radii. Labels have been added. 32 Offsitc work will require offsite easements. Letter(s) of intent from the adjacent property owner must be submitted prior to the hearing, and easements must be complete prior to the filing of the mylars. An of Isitc cascrncnt will be required for the Detention Pond outfall. Stewart & Associates has been working with the Fossil Creek Homeowners Association on this matter. Every effort has been and will continue to be taken to respect the concerns of silts in the Creek due to construction. Through discussion with Bob Zackley of FC Stormwatcr, silt fence has been called for at the southern end of the pipe trench to remain in place and be maintained until the Native Grass revegetation has been established. All disturbed ground will he returned to existing grades and re -seeded with a native seed as determined by FC Natural Resources and shown on the Landscape plans. 127 Please provide directional ramps at the corner of college and fossil creek for the ultimate and current configurations. Currently there arc no directional ramps at this intersection. (See Response to Current Plannin, General comment 163). 128 Please label the curb return radii for all curb returns. (See Response to Engineering Ovcrall Utility Plan comment 29). 129 The sidewalk along College must be installed with this development, so any needed retaining walls to accomplish this must also be installed with this development. (to City and CDOT standards) The ultimate condition for College is a six -lane arterial as shown in LCUASS plus whatever additional requirements CDo'r may have. We have submitted the current ultimate design to Katie and were informed said design was acceptable. 131 For now, the design of a 6' bike lane between the right turn lane and the through lane on College must be provided and constructed with this development. The requested additional pavement width and striping have been accommodated in the interim desitn. The request requires the under grounding of the overhead PVREA lines. which would not otherwise have been required. Calculations for additional width requirements have been performed using the existing striping, which currently provides adequate travel and turn lane widths. 132 Please show striping plan. Striping plan has been added to both the interim and ultimate design sheets. Landscaped peninsulas with raised curbs define vehicular area entrances. This standard is therefore satisfied. Parking Lots — Required Number of Off -Street Spaces for Type of Use [3.2.2(K)] — This Section of the Land Use Code specifies that vehicle servicing and maintenance establishments can have up to 5 spaces per 1000 square feet of gross leasable area of building. However, in the event that on -street or shared parking is not available on land adjacent to the use, the maximum allowed parking may be increased by 20%, provided that the amount of parking lot landscaping is also increased by 20%. The applicant proposes 46 parking spaces, which does in fact exceed the 42 spaces that would be allowed if the 5/100C ratio were applied, however there is no on -street or shared parking available on any adjacent site, and the parking lot landscaping exceeds the minimum required by more than 20%, therefore 46 spaces is permitted. 3. Solar Access, Orientation, Shading [3.2.3] — The proposed plan is designed in a way that protects its roof's access to sunshine between gam and 3pm on December 215c. The physical elements of the development plan are located and designed in a way that will not cast a shadow onto structures within the site or on adjacent property greater than allowed in this section. 4. Site Lighting — [3.2.4] — As required the applicant is using lighting fixtures that are concealed and fully shielded featuring sharp cut-off capability which reduces up -light, spill -light, glare and unnecessary diffusion on adjacent property. The maximum and minimum lighting on -site lighting levels are in compliance with this section. B. Engineering Standards [3.3] Plat Standards [3.3.1] As required, the general layout of the lots, roads, driveways, utilities, drainage facilities, and other services within the proposed development are designed in a way that utilizes the existing street system within the neighborhood. Proper right-of- way has been dedicated for adjacent public streets, emergency access easements, and utility easements have been provided as needed to serve the area being platted. Water Hazards [3.3.3] —The PDP has been reviewed by and complies with the requirements of the Stormwater Department. Engineering Design Standards [3.3.51— This project complies with all design standards, requirements, and specifications for all of the commenting departments and agencies. C. Building Standards [3.5] Building and Project Compatibility [3.5.1] —The proposed building uses the same colors and materials already found in the neighborhood therefore is compatible with the established architectural of buildings in the surrounding area. Utility meters, trash collection, and other service functions are incorporated into the overall design scheme of the site so that these uses are screened and out of view of high visibility areas. 2. Mixed -Use, Institutional and Commercial Buildings [3.5.3] — The applicant was granted a modification to Section 3.5.3(B)(2) of the Land Use Code from the Planning and Zoning Board on August 15, 2002. The standard would normally require buildings to be setback no more than 15 feet from streets classified smaller than a full arterial, however the applicant was granted permission to position the building so that its setback from Fossil Creek Parkway varies between 26.5 feet and 39.5 feet. The building otherwise satisfies the requirements of Section 3.5.3 for variation in massing, fapade treatment, entrance treatment, and the base and top treatment requirements, therefore the application satisfies the requirements of this section of the code. D. Transportation and Circulation [3.6] 1. Master Street Plan [3.6.1 ] — College Avenue is designated as a "Major 6 Lane Arterial" on the Master Street Plan, and Fossil Creek Parkway is designated as a "Collector 2 Lane." According to current standards, there is excess right-of-way on College Avenue. This project proposes vacation of the excess College Avenue right-of- way, as well as the vacation and dedication of small portions of right-of-way on Fossil Creek Boulevard. These vacations must be approved by council, which staff anticipates will be approved without controversy. Staff does however recommend that a condition be placed on the approval of the P.D.P. that conditions such approval upon successful right-of-way vacation by City Council. Transportation Level of Service Requirements [3.6.4] — The Transportation Planning Department and the Traffic Operations Department have determined that the project meets the applicable Transportation Level of Service(LOS) requirements. FINDINGS OF FACT/CONCLUSIONS After reviewing the Discount Tire at Fossil Creek P.D.P., staff makes the following findings of fact and conclusions: 1. The proposed land use is permitted in the (C) Commercial zone district. 2. The Project Development Plan complies with all applicable district standards of Section 4.17 of the Land Use Code, the (C) Commercial zone district. 3. Upon action by City Council vacating several portions of College Avenue and Fossil Creek Parkway rights -of -way, the Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code, except section 3.5.3(B)(2) where a modification was granted by the Planning and Zoning Board. RECOMMENDATION: Staff recommends approval of the Discount Tire at Fossil Creek P.D.P., File # 26-02 under the condition that City Council does in fact vacate the proposed portions of College Avenue and Fossil Creek Parkway rights -of - way as anticipated.
