The. City will patch those sections of the street which have deteriorated seriously so as to preserve the street through this coming winter. we will then assess in spring the condition of the base course under the asphalt to see whether these measures have been successful in reducing the amount of moisture enough to permit us to overlay the street with the assurance that this will resolve the problem of deter- ioration. As I indicated previously, the deterioration of the street definitely appears to be a direct result of the over -irrigation of the laudscaped area adjacent to the street. On this basis, I feel that the Foothills Fashion Mall should pay 1/2 of the cost of the overlay necessary to restore this section of the street to a reasonable condition. As you indicated we will bill you in this amount upon completion of the overlay work ne):t summer. Thank you for your help in this matter. I have been personally checking the runoff and amount �.' of water on Foothills Parkway when these sprinklers are on and if, as you outline, "the deterioration... has continued" there must be some other problems with the street. Foothills Fashion Mall was designed, erected and operates under the various rules, codes and laws of the City. There is no part of Foothills Fashion Mall that was not inspected and approved by the City offices in question. In our day-to-day operation, we strive to provide the finest facility possible to serve the Fort Collins trade area and will con- tinue to do so. In this day-to-day operation, the Management of Foothills Fashion Mall will cooperate in every possible manner with the City of Fort Collins to keep the Mall property and adjacent areas clean, safe and in good repair through maintenance, preventative maintenance and accepted management procedures on the Mall property. We do not expect to be exposed to the liability of the maintenance of properties outside of Mall property other than through the taxes paid f to support City operations. There is doubt in our minds as to the extent of actual damage or deterioration caused by the Mall sprinkler system, if any, although we have complied with all City requests and at some expense have sealed one full row of sprinklers at the base of the :bank and reduced the amount of sprinkling in the other row by reducing the head size. Mike Herzig has been working with your engineers regarding the final_ utility plans for both phases 1 and 2. There appears to be a consider- able amount of work yet to be done by your engineers. The utility plans needs to be completed before the Planning and Zoning Board will approve the final PUD plans. Also, the development agreement is prob- ably going to be complicated as a result of some issues that will not be resolved until after Board approval. 2. The vacation of Foothills Parkway and Monroe Drive should begin immedi- ately. The owners abutting the proposed vacation needs to submit a letter requesting the vacation. The letter should also include a statement as to how the ROW is to be distributed among the property owners. Attached to the letter should be a legal description of the property to be vacated and an 8 1/2" x 11" reduced map of the subject areas. Submission of this information to Mike Herzig will begin the process. The process takes approximately 6 weeks before City Council approval. There is a process that must be followed before the City will consider condemnation for any needed easements or ROW. First, the applicants will need to demonstrate and document that a fair attempt was made to purchase the easements or ROW. If there is an impasse at securing the property, t-iis needs to be documented and a letter submitted to the City reques,ing City condemnation. The letter should include a legal description of the area to be condemned and a market appraisal. With this information, the processing of the condemnation could proceed. City Council approval will be required of any condemnation action. I would suggest you' contact Mike Herzig and/or Ron Mills for further inf ormation. 4. Raised walks should be provided over the storm drainage channel pan on all defined walks. This should be checked against flow capacity. 5. The site and landscape plans should show all handicapped ramps. Ramps should be provided at all pedestrian crossings and at points close to handicapped parking stalls. Additional ramp areas should be provided on the plans. 6. The curb bulges at the Monroe/Stanford intersection should be shown on the site and utility plans. All driveway entrances to the project should be dimensioned. There ace some additional minor changes to the design of the circulation system and parking that are recommended. See me for details. The parking design on Mathews Street needs to be justi- fied. The owners of abutting properties needs to be contacted for their input on the parking arrangement. The parking should be pulled back 10 - 20 feet from the property lines of the homes. Sidewalks should be shown along the east side of Mathews Street between the major entrance to the Mall and Swallow Road. 7. Fire hydrant locations should be shown on the site plan. 8. The preliminary approval was conditioned on certain improvements being made to the surrounding street system. These items should be included as notes on the final site plans. 9. The applicants should provide additional detail on proposed lighting, signage and pedestrian amenities. The applicant's need to thoroughly analyze special treatment measures for the major pedestrian ways and loop road system. The proposed location of planters should be shown on the landscape plans. A typical design of pedestrian "humps" should be shown on the site plan. Additional areas for humps are recommended. The plans indicate a limited use of "special textured" pedestrian crossings. Details of this treatment should be indicated on the plans. The staff would recommend that this treatment be utilized at selected intersections in the Mall parking lot to enhance their appearance and importance. Foothills Fashion Mal "Foothills East July 9, 1987 - Page 10. Additional landscaped islands and larger islands at the end of rows of parking is recommended. 11. Overall, the landscape plan looks very good. However, the staff would recommend that a single species of deciduous trees be used on both sides of raised islands throughout the loop road. This would further help identify this important vehicular route. No large trees, street lamps, etc., can be placed in easements for water and sewer lines. Please verify. 12. Additional bicycle parking should be provided at the entrances to the 26,000 sq. ft. addition, the Penney's addition and at least two or three different locations in the Foothills East project. Motorcycle parking should be signed for such. Please eliminate note number 6 from the site plan. 13. Building erwelopes and footprints with dimensions should be indicated on the site plan. Dimensions of all landscaped islands and sidewalks adjacent to the buildings should be shcxan on the plans. 14. Exact height of buildings should be noted on the plans. 15. Energy conservation measures should be indicated on the site plans. 16. Final architectural elevations for all sides of all new buildings should be submitted, indicating exterior materials and colors. 17. If improvements and/or buildings are to be phased, this needs to be indicated on the site and Landscape plans. 18. Note number 9 on the site plan appears to conflict with typical dimen- sions shown on the site plan. Please resolve. 19. The title of the phase 2 needs to be clarified that it is a preliminary plan for the Foothills East; a final plan for a phase of Foothills east; and, a final plan for the Foothills Addition. Notes should also be included on the plan to that effect. 20. 8 1/2" x Il" PMT reductions, ten full size copies of the site, lands- cape and building elevations, and rendering copies of the plans should be submitted to this office no later than noon on'July 20, 1987. 21. Signed mylars of the site, landscaping, building elevations, subdivi- sion plat, development agreement and Site and Landscape Covenants, as well as any other final documents should be submitted to this office no later than noon on July 23, 1987. Upon further review of the Shoreline P.U.D., the City Engineering Divi- sion has decided to recommend denial of the request for variance to allow a non-standard street width. The current standard is 36 foot wide resi- dential streets and the Developer is proposing a 28 foot wide street. The narrow street will have single family housing on both sides with only the standard 2 off-street parking areas per house. The Engineering Divi- sion recognizes a strong potential of parking on both sides of the street, leaving only one lane open for traffic to move though the devel- opment. After re-evaluating the request for the variance to be granted for the sub -standard street, the Engineering Division has decided this is not acceptable, and the request for the variance does not justify the sub- standard street design. Davis, Director of Development Services 1 RE: Foothills Fashion Mall Expansion - Street Vacations Yesterday the question was raised during the Mayor's Lunch about what would happen to the portions of Monroe Drive and Foothills Parkway if the streets were vacated and then the mall expansion project were to stall and not be completed. Tn a later meeting to discuss the issue, Staff explored such questions as would the streets be re -dedicated? How do we assure that the streets are kept open as private streets? What would happen after vacation when the streets are private until the mall improvements are constructed? Staff and the applicant concluded that the important issue is the assurances that the project proceed as planned and the vacations are properly executed. To protect both the interests of the City and the developer, the following course of action is recommended: 1. That the City Council approve the vacation of the streets on first reading of the ordinances. 2. Between first and second reading, in addition to providing the signatures on the request for vacation, the developer and the City will enter into an agreement that specifically defines the phasing of the improvements, including a traffic access and control plan for each phase of the project. The agreement would be similar to a "development agreement" IDUt would specifically deal with the vacations. The developer will provide dates for when the vacations would become effective. The Ordinances before the City Council will be amended in time for the second reading to include the effective date(s). With the effective date(s), it will leave time for the ordinance to be repealed if conditions are not met or if the developer should abandon plans for the expansion. 300 LaPorte Ave. • P.O. The Monroe Drive intersection will be affected by traffic from the Foothills Fashion Mall expansion and, potentially, also by the proposed additions to The Square shopping center. If a new fast food restaurant is built in the southeast corner of S.H. 287 and Monroe Drive, the increase in right turning vehicles would warrant consideration of a right -turn deceleration lane on S.H. 287 similar to that proposed for Horsetooth Road. It may be desirable to delay final action on these plans until the review of The Square Amended Master Plan is complete, or to at least locate utilities to allow for a future deceleration lane. Whether or not right -turn deceleration lanes are constructed at these intersections, we encourage uniform corner turning radii. Both intersections should have minimum 50-foot radii when use by large trucks is intended on a daily basis. If this is not feasible, the maximum radius possible should be provided. The type of improvements shown in this utility plan do not require the issuance of an Access Permit. This work should be done under the City's supervision to Ensure proper installation and public safety during construction. I have not waived any fees in the past 18 months, but have reduced some fees based on special circumstances where strict compliance did not seem fair. Many have complained that the fees are too high, but looking at the deficit in the fund, I can't be too sympathetic. In looking at this request, I thought I should get your reaction to my recommendation because I do not believe that Everitt will stop at this level. The mall expansion information follows- - all of the original buildings, except Penny's were built before the street oversizing fund. Penny's paid $12,517 in SOS fees. In fact, Everitt's were refunded another SOS fee ($9,578) because they claimed th new SOS ordinance had not gone into effect when they sumitted their plans for the first expansion. - the city will be building $70,000 in signal improvements through Federal Aid Urban Systems at Stover/Stanford, JFK Parkway/Horsetooth, and College/Horsetooth that were identified as improvements needed in the traffic study for the mall expansion, but were scheduled by transportation division - Foothills Parkway was built in 1980. Everitt's paid $20,600 as their residential share and the city paid $88,640 from street oversizing and capitol projects. The new expansion will eliminate this street that is only 7 years old. This information conflicts with Everitt's claim that they paid for all oversized streets around the mall. - the traffic study indicates that traffic volumes will increase by 48% on week ends and 57% on week days because of the total 167,000 s. f. expansion of Mervyn's, May D&F, Penny's, Everwest and Sears. This is a substantial increase in traffic for such a large facility. - the developer will be required to make several street improvements that are directly related to traffic impacts and would be considered his responsibility, but is the basis for his request for waiver ,i.e. purchase ROW and build a double left turn on Horsetooth, a new right turn on Horsetooth, reconstruction of cross pans on Monroe, left turn signal phases on Swallow and curb bulges to mitigate neighborhood concerns. The only item that is beyond the normal is the transit center which I would not consider an offset to the street oversizing fee. I have calculated the street oversizing fee two different ways to see how different methods compared. - normally we would use the per cent increase in building size and apply that to the gross land area, then times the fee per acre -- in this case Mervyn's SOS fee would be $1121400 - using the traffic impact from the traffic study, Mervyn's SOS fee would be $80,000 to $100,000. This method is difficult to calculate because the trafffic study analyzed all the proposed expansion and not just Mervyn's I would recommend that the fee not be waived for the following reasons: 1. the mall has not paid SOS fees in the past, except for Penney's expansion in 1980 2. the expansion will create a significant increase in traffic which will affect city streets that could require additional widening 3. the city has paid for oversized streets in this area and will continue with JFK Parkway in the future. The drainage off your land has always gone under a small pipe going across the highway and into a series of underground drainage that Herb Spencer installed in the "50`s. That pipe has always taken care of the drainage on the land as it has been. We have done nothing to interrupt that pipe. What has happened is that the highway department contractor when they installed the large pipe recently, across the highway, they damaged the old pipe that was running under the highway and caused your water to back up on to your property. You indicated in your letter that I directed someone to block the newly installed drainage system, which is not correct. Both Jim Stewart and myself have told everybody that all they have to do is, to hook up the old pipe together with the end of the pipe on our property and run the water underground as it has been. However, we cannot take a pipe of 54 inches of water going across on the top of the land which is the size of the pipe now coming under the highway. We are in the process of trying to construct a storm drainage system to hook up with the large pipe, however, I believe that everybody has been informed that this cannot happen immediately and the final solution will come when we hook our drainage system up with the City and the highway department have just installed coming across the highway. The develop- ment agreement for the project dated July 6, 1988, between the City of Fort Collins and Everwest, states that the transit center is to be designed and built as a part of Phase 3 of the development. (Section 2.E. on page 7 of the agreement) The Mall expansion project, as approved by the City and as under construction, is only for Phases I and 2. Phase 1 is to construct the new Mervyn's store and the Mall expansion into the old Denver store site. Phase 2 is to construct the addition to May D & F. Connected with the Phase 1 and 2 building improvements are parking lot and street improvements described in the develop- ment agreement and on the utility plans. Phase 3 of the development is concep- tually planned as expansion of the Sears store and remodeling of the internal driveway circulation system between the Foothills Fashion Mall, The Square and Foothills Plaza shopping centers. The only part of the transit center included in the approved Phases, is the definition of its future location, and Everwest has set aside that space. In the mean time th.- location is to be improved to serve bus stops as is shown on the approved site plan. I hope this will clarify when the transit center is to be constructed. Sincerely, Michael R. Phase I, item #5, requires EVERWEST to widen the south side of Horsetooth Road to provide space for the installation of westbound double left turn lanes on Horsetooth at South College Avenue. Successful completion of this requirement necessitates the cooperation of the landowner, John Reidman, and EVERWEST for agreement as to how this installation will occur. I have made numerous attempts to work out a feasible plan with Mr. Reidman; Mr. Reidman has not responded. I have instead received requests for additional information through a real. estate broker, Bill Warnock. In response to your need for information, I requested Jerry Moore, MAI, to prepare an appraisal of this land. EVERWEST cannot complete the development requirements until the right to consent on this right-of-way has been resolved. This pond is just west of Stanford Road, and is shown on Sheet 12 of 18 of the Utility Plans for the Foothills Fashion Mall Expansion Phase H. The planned outlet grate elevation was 4995.00, and the surveyed elevation is 4995.08. The overflow spillway elevation was planned to be 4997.40, and is surveyed as 4997.24. The required volume is 15782 cubic feet, anc the revised plan volume of the pond was 17400 cubic feet. The volume I have calculated from our survey made November 6, 1989, is 17002 cubic feet. This as —built volume of 17002 cubic feet is less than the planned volume of 17400 cubic feet, but it is quite a bit greater than the required volume of 15782 cubic feet; therefore, the pond is adequately constructed. For the past several weeks there has been a great amount of stagnant water collecting on our property. We have investigated the cause of this and find that, at your direction, the City of Fort Collins and the Highway Department have completely blocked the newly installed drainage system. This appears to be keeping your property quite dry, but has flooded our property and I fear has damaged our drainage system. We are planning immediate development of this property and ask that you immediately have the drain opened so that our land can be freed of the damaging influence of the lake which has now been formed. Foothills Fashion Mall, being the major commercial development, has agreed to pay for 50 percent of the estimated cost of$15,173.00. Steele's Cash Market has agreed to pay 25 percent of the above estimated cost and the intent of this letter is to solicit your participation on the remaining approximately $4,000.00.
