In addition, it is our intent to process any request for vacation of this easement at the time the required documentation as prepared by a licensed Colorado professional engineer has been provided to the office of the City Engineer. The City will vacate the traffic easement upon filing and processing the appropriate documentation from the property owner. 2. The City has no intention of enforcing the easement or citing the property owner with a violation due to the building's encroachment upon the easement. Please send the letter to my address and include the following somewhere in the letter: " I am providing you with this letter for the benefit of North American Savings Bank, F.S B. who may rely upon the statement made herein." With this letter is a copy of an Improvement Location Certificate ("ILC") that was prepared by Burdick Engineering Consultants Incorporated on September 2, 2003. The Traffic Easement has been highlighted on the ILC for your reference. All existing facilities, structures and roads are shown on the ILC. Our client will proceed with getting a specific legal description for the Traffic Easement prepared while you obtain the annroval of the various Citv departments.
