T'M-R AR, Clyde 1.1. Lyon and J. F. Spangler have this day filed and presented their petition and application to the City Council as the owners of more than two-thirds of the entire area embraced in what is known as Yenwood Heights, a proposed addition to the City of Fort Collins, wherein and whereby said petitioners and applicants petition the City of Fort Colline for the annexation of all the territory erabraaed in �mt is knom as I.enwood Heights comprising the lots and blocks as shown in the plat thereof annexed to said petition, which said plat has boon duly signed and aclnowled^ed by the petitioners, granting, conveying and dedicating the streets and alleys in said proposed addition to the City of Fort 'Collins for the use of the public; to be ic:own as Irnwood ?Ieights of the City of Fort Collins and to be included within the limits and jurisdiction thereof, which said map or plat annexed to said petition shoes that the proposed streets and alleys therain are in confomaity as to coi.r©es and angles with the streets and alleys of adjoining portions of said City of Fort Collins; and that all streets have boon duly brought to the legally established grade in accordance with the recrairements of the ordinances of the City of Fort Collins and Ordinance No. 14, 1924, except as to Wayne and Gordor. Streets, which are to be brm%ght to grade by the applicants;: and. that all necessary bridges and culverts Nava been constructed therein as required by said Ordinance Yo. 14, 1924, and the cost thereof been paid by the applicants; and all taxes assessed against the said territory so embraced in said proposed addition lava been paid; and the said application has attached thereto the certificate of the deputy electrical inspector that all buildings situate in or on the territory proposed to be annexed ave been inspected by him as provided by Section 1 of Ordinance No. 14, 1924 and his certificate filed for the same and. provisions have been made for coriplying with the requirements of the ordinance as to defects as shown by the certificate of inspection; and in the said application the applicants each for himself and his grantees covenants and agrees to and with the City of Fort Collins t'.-zt upon the acceptance of the said application, it is expressly agreed and understood that the applicants and their grantees expressly covenant and agree that they will be bound by and will observe and obey the ordinances in force and effect at the time of tle acceptance of avid annexvtion of addition respecting the installation and payment for local public improvements; therefore BE IT RESOLUD By the City Council of the City of Fort Collins that the petition of Clyde M. Lyon and J. F. Spengler for the annexation of all the territory embraced in what is knovM and described as Kenwood :'.eights, as shoirn by the plat thereof annexed to said petition, be accepted and approved, and that t.e territory* embraced in said plat of Kenwood Fieiehts be annexed to and made a part of the City of Fort Collins and be included within the limits and jurisdiction thereof, and that the City Clark be and he is hereby authorized and directed to prepare a certified copy of this resolution to which shall be attached a plat of said Kenwood F'.eights, and file the same with the Clerk and Recorder of Larimer County for record; and that a duplicate thereof be filed in the office of the City Clerk; and BE IT FTJR^irR RESOL= By the City Council that in accepting and approving the plat of Kenwood heights and authorizing its annexation to the City of Fort Collins, that the City of Fort Collins does not assume any obligations ref7necting the construction of water mains, sevver lines, gas mains or electric light lines with respect to the service of the said nadition axcept as may be required and provided by the owners of property wit'iin the limits of said addition and except as may be initiated by the owns rs of property within the licaits of said addition in compli^nce with the urns end provisions of Ordinance No. 7, 1921, relating to local public inr?rovements, and as anended by the addition thereto of Section 32 concerning the construction of extensions to water mains. RO ME TOW, the duly appointed, qualified and acting City Clerk of the City of Fort Collins do hereby certify and declare that the above and foregoing resolution is a true, correct, fall and complete copy of a resolution duly adopted by tl-P City Council of the City of Fort Collins ac.epting and apr.,roving the plat of what is lmown and described as Kenwood :Heights, a proposed addition to the City of Fort Collins, and that the plat hreto attached is a duplicate of the original filed in my office, vi-,ich said resolution vole duly passed and adopted at a regular, meeting of file City Council held on the 21st day of June, A.
