HomeMy WebLinkAboutWEST PROSPECT ANNEX ORDINANCE # 32 1965 - Filed A-ANNEXATIONS - 2004-04-29ORDINANCE No. 32 , 1965, ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOi•N AS THE WEST PROSPECT FIRST ANNEXATION TO TINE CITY OF FORT COLLI"S AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS- DICTiGN 'THER OF, PURSUANT TO T::E A UTEORITY CONTAINED 1N A:'%TICT.Z 11, CY4PTER 139, COLORADO REVISED STATUTES 1953 WP.ERELS, heretofore a written petition was presented to the Council of the City of Fort Collins in substantial compliance with the provisions of Article 11, Chapter 139, Colorado Revised Statutes, 1953, by the owners of more than fifty per cent (507) of the area and who comprise the majority of landowners residin;; in the area of land embraced in what is known as the West Prospect First Annexation to the City of Fort Collins, wherein and whereby said petitioners petitioned the City of Fort Collins for annexation of all the territory embraced in what is known as the West Prospect First Annexation to the City of Fort Collins, Colorado, comprising the lands shown in the plat thereof attached to said petition and more particularly described as hereinafter set forth, and WHEILFAS, said petition was accepted by the Council of the City of Fort Collins by resolution passed and adopted on April 22, 1965, and WHEREAS, notice for hearing on the 3rd day of June, 1965, on an ordinance approving the annexation of said territory and including the same within the limits and jurisdiction of the City of Fort Collins was duly published as provided by law, and WHEREAS, the Council of the City of Fort Collins has found that the petition and the documents thereto attached meet the requirements of Article 11, Chapter 139, Colorado Revised Statutes, 1953, and WHEREAS, no proceedings for an election to determine the question of annexation have been initiated by written counter -petition as provided by law and no objection to annexation having been made; BE IT GRDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That after due consideration of the petition for annexation, the petition for the annexation of all the territory in what is known and described as tho West P�ospcct First Annexation to the City of Fort Collins, Colorado, as shown by the plat thereof annexed to said petition and which is more particularly described as follows, to -wit: A traCt of lanr', situate in the North Half (NA of Section 21 aid the Scuth-ast Quarter (SE'.-) of Section 16, Township 7 Noma, Range 69 Wcst of the Sixth P. M., County of Larimer, State of Colorado, which considering the North line of Section 21 as bearing S. 89°41' E. and with all bcaringa contained herein relative thereto is contained within the boundary lines which begin at a point which bears S. 89°41' Z. 702.60 feet and again S. 00°19' W. 30.00 fc:et from the North Quarter corner of said Section 21 and run thence S. 89°41' E. 446.26 feet; thence N. 00006'30" W. 632.65 feet; thence N. 89*41' W. 82.49 feet; thence N. 00°06'30" W. 716.20 feet to a point on the South line of the Alvin L. Miller First Foothills Annexation to the City of Fort Collins, Colorado; thence' along said South line S. 89°41' E. 250.00 feet; thence along t`,c Westerly line of the First and Second Elliott - Miller Annexations to the City of Fort Collins, Colorado, S. 0002C' E. 886.26 feet; thence S. 00020' E. 462 65 feet; thence N. 89*41' W. 119.07 feet; thence S. 00*19' W. 450.00 feet; thence N. 89041' W. 500.00 feet; thence N. 00°19' E. 450.00 feet; to the point of beginning, containing 11.7899 acres, more or less; be accepted and approved and that said territory be annexed and made a part of the City of Fort Collins and be included within the limits and jurisdiction of the City of Fort Collins as an "A" Residential District, and that the City Clerk be and he is hereby authorized and directed to prepare certified copies of this ordinance, to each of which shall be attached a plat of said West Prospect First Annexation to the City of Fort Collins, Colorado, and shall file a copy thereof in the office of the Clerk and Recorder of the County of Larimer, and another copy thereof in the office of the Clerk of the City of Fort Collins, together with a certified copy of said petition, and another copy .of said petition and approving ordinance with the Secretary of State of the State of Colorado. Section 2. That in accepting and approving the plat of the West Prospect First Annexation to the City/of Fort Collins, the City of Fort Collins does act :.ssnaa obli;ntionz respecting the construction of water mains, sewer lines, --zz .=,ins, electric li.-ht lines or other services or utilities with -2- respect to service of said addition, except as may be required and provided by the owners of the property within the limits of said addition in compliance with the terms and provisions of Chapter 15, Code of Ordinances of the City of Fort Collins, Colorado, 1958, as amended, relating to local and public improvements. Introduced, considered favorably on first reading, and ordered published this 3rd day of June, A. D. 1965, and to be presented for final passage on the 24th day of June, A. D. 1965.
