RESOLUTION NO. PZ92-19
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF AN ACCESS AND UTILITY
EASEMENT ACROSS PART OF LOTS 17, 18, AND 25
OF PHEASANT RIDGE ESTATES SUBDIVISION
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner and Developer of Pheasant Ridge Estates
Subdivision, City of Fort Collins, Larimer County, Colorado, has
requested that the City vacate a portion of an access and utility
easement across part of Lots 17, 18, and 25 of said subdivision;
and
WHEREAS, said portion of said access and utility easement is
no longer necessary and the vacation request has been reviewed and
approved by the pertinent City and private utilities and the Poudre
Fire Authority and they have no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the access
and utility easement more particularly described, as follows, to
wit:
A part of Lot 25, Pheasant Ridge Estates, Fort Collins,
Larimer County, Colorado, which begins at a point which bears
N 89' 39' 00" E 10.00 feet and again S 00' 21' 00" E 8.00 feet
from the Northwest corner of said Lot 25 and run thence N 89'
39' 00" E 24.00 feet; thence S 00° 21' 00" E 30.00 feet;
thence S 89' 39' 00" W 4.00 feet; thence S 00° 21' 00" E
156.00 feet; thence S 89' 39' 00" W 20.00 feet; thence N 00'
21' 00" W 186.00 feet to the point of beginning; together with
A part of Lots 17 and 18, Pheasant Ridge Estates, Fort
Collins, Larimer County, Colorado, which begins at a point
which bears N 89' 39' 00" E 10.00 feet and again S 00' 21' 00"
E 6.00 feet from the Northwest corner of said Lot 18 and run
thence N 89' 39' 00" E 20.00 feet; thence S 00' 21' 00" E
167.17 feet; thence N 63' 41' 04" W 22.38 feet; thence N 00'
21' 00" W 157.13 feet to the point of beginning.
