BEING AN ORDINANCE VACATING A TRACT OF LAND ACQUIRED BY
Tffli CITY OF FORT COLLINS FOR STREET PURPOSES.
WHEREAS, heretofore, the City of Fort Collins acquired the property
hereinafter described for use as a public street; and
WIIERFAS, such property is not open as a public street and is not
needed for municipal purposes, nor will the same be needed for municipal
purposes, in the future; and
WHEREAS, the owner of the adjoining property has petitioned the
City Council to vacate such tract of land; and
WIIERFAS, said tract of land abutts upon t,IHugh Street as dedicated
and improved in the City, and the owner of the adjoining tract of land has
agreed to pay certain assessments which were incurred in connection with the
improvement of [McHugh Street, if said tract is vacated; and
WHEREAS, it appears that the rights of the residents of the City
of Fort Collins will in no way be prejudiced by the vacation of said tract
of land.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following described tract of land now owned by the City, to -wit:
A tract of land situated in the SIV 1/4 of Section 18, Township
7 North, Range 68 West of the 6th P.M., City of Fort Collins,
County of Larimer, State of Colorado, which considering the
West line of said SIV 1/4 as bearing North and with all bearings
contained herein relative thereto, is contained within the boundary
which begins at a point which bears N. 89015'00" E. 1248.22 feet
from the IV 1/4 corner of said Section 18, and run thence S. 00002,30"
E. 122.91 feet, thence along the arc of a 23.88 foot radius curve
to the right a distance of 8.89 feet; the long chord of which bears
N. 53029107" IV. 8.80 feet; thence N. 42048'54" W. 33.20 feet;
thence along the arc of a 93.75 foot radius curve to the right a
distance of 26.81 feet; the long chord of which bears N. 34037'16"
IV. 26.72 feet; thence N. 26025'37" W. 13.33 feet; thence along
the arc of a 77.66 foot radius curve to the right, a distance of
63.04 feet; the long chord of which bears N. 03110'16" W. 58.78
feet; thence N. 89015'00" E. 53.82 feet to the point of beginning;
be and the same hereby is abolished, vacated and abatted, and the ownership
of said tract shall revert to the owner of the lands adjoining said tract on
the Last.
Introduced, considered favorably on first reading, and ordered published
this 28th day of September, A.D. 1972, and to be presented for final passage on
the 19th day of October, A.D. 1972.
