WHEREAS, The pwners of Lot Twenty (20), in Block Eleven (11), in the City of Fort Collins, have petitioned the City Council to vacate a portion of Chestnut Street abutting on Lot Twenty (20), in Block Eleven (11), in the City of Fort Collins; therefore BE IT ORDAINED BY THE CITY COUNCIL OF.THE CITY OF FORT COLLINS: Section 1. That _portion of Chestnut Street abutting on Lot Twenty (20), in Block. Eleven (11) in the City of Fort Collins and described by metes and bounds as follows, towit: Beginning at the West corner of said Block Eleven (11); thence East along the north property Mn of Lountain Avenue 32.37 feet; thence Ilorth at right anZies to the north property line of :ountein Avenue 37 feet to the southeast property lin: of Chestnut Street' , thence sounin2stcrly along thr southeast _ rcperty line of t i e Section 2. In the opinion of the City Council an emergency exists for the preserva- tion of the public health, peace and safety, and this ordinance shall take effect upon its passage and publication, under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter. That Section 1 of Ordinance No. 1 , 1920, being an eraergency ordinance relating to the vacation of a certain portion of Chestnut Street abutting on Lot Twenty (20), in Block Eleven (11), in the City of Fort Collins, be amended so as to read as follows: "Section 1. That portion of Chestnut Street abutting on Lot Twenty (20), in Block Eleven (11), in the City of Fort Collins, ant described by metes and bounds as follows, towit: Beginning at the Southwest corner of Lot Twenty (20), in said Block Eleven (11); thence ?lest along the line of the North property line of Mountain Avenue 32.37 feet; thence Northeasterly 49.16 feet on the line of the East property line of Chestnut Street; thence South along the Vest line of Lot Twenty (20) 37 feet to point of beginning, is hereby vacated upon the express condition that no claim for equitable adj-ust:nent will be considered or allowed in the event ot any special iirprovewent taxes hereafter assessed gains: said .:.Cated tract."
