BEING AN ORDINANCE VACATING A PORTION OF CHERRY STREET
IN THE CITY OF FORT COLLINS, COLORADO
WHEREAS, the City Council has been petitioned to vacate a portion
of Cherry Street in the City of Fort Collins, said portion to be vacated being
more particularly described as follows, to -wit:
and
Commencing at a point which is North 89'45'15" East
136.70 feet from the SW corner of the NWJ4 of the NEk,
Section 10, Township 7 North, Range 69 West of the 6th
P. M., thence North 89°45'15" East, 101.13 feet, thence
South 00014'45" East to the South line of Cherry Street,
thence West along the South line of Cherry Street to a
point which is South 00°14'45" East from the point of
beginning, thence North 00°14'45" West to the point of
beginning;
WHEREAS, said street as now platted cannot be used and an alternate
street has been furnished to replace the street to be vacated, and
WHEREAS, it appears that the rights of the residents of the City
of Fort Collins will be in no way prejudiced or injured by the vacation of
said portion of said street.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following portion of Cherry Street in the City of Fort
Collins, more particularly described as follows, to -wit:
Commencing at a point which is North 89°45'15" East
136.70 feet from the SW corner of the NW'y of the NE'k,
Section 10, Township 7 North, Range 69 West of the 6th
P. M., thence North 89°45'15" East 101.13 feet, thence
South 00°14145" East to the South line of Cherry Street,
thence West along the South line of Cherry Street to a
point which is South 00014'45" East from the point of
beginning, thence North 00°14'45" West to the point of
beginning;
be and the same hereby is abolished, vacated and abated.
Introduced, considered favorably on first reading and ordered
published this Ilth day of February, A. D. 1965, and to be presented for
final passage on the 4th day of March, A. D. 1965.
