FIRST REPLAT 0 z� o WHEREAS, the Planning and Zoning Board of the City has approved the planned N r a, unit development and plat entitled "Fairbrooke 5th Filing P.U.D."; and o 0 WHEREAS, the Planning Director has approved a minor subdivision entitled N "Fairbrooke 4th Filing P.U.D."; and o WHEREAS, the aforesaid Fairbrooke 4th and 5th Filings constitute a rep] at > c of the Charleston P.U.D. First Replat; and H WHEREAS, the City Council desires to vacate the street rights -of -way as �0 N dedicated on the Charleston P.U.D. First Replat without vacating any redundant dedication of street rights -of -way as shown on the Fairbrooke 5th Filing P.U.D.; O and z H i4 O O WHEREAS, City agencies and private utilities have been notified of the replats and report no objection to the proposed vacation; and o U WHEREAS, there will be no cost to the City in making the proposed vacation; ro andIn y �In WHEREAS, the rights of the residents of the City will not be prejudiced eM by the vacation of said street rights -of -way. d O NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS N that the street rights of way as described and dedicated on the Charleston P.U.D. First Replat be, and the same hereby are, vacated, abated and abolished; provided, however, that this vacation ordinance shall not affect in any way the street rights -of -way described and dedicated on the Fairbrooke 5th Filing P.U.D., which dedication shall continue in existence and survive this vacation ordinance. Introduced, considered favorably on first reading, and ordered published this 5th day of November, A.D. 1991, and to be presented for final passage on the 19th day of November, A.D. 1991.
