BEING AN EMERGENCY ORDINANCE RELATING TO THE VACATION OF AN
IRREGULAR TRACT LOCATED AT THE INTERSECTION OF EAST MOUNTAIN
LINCOLN AVENUE AND JEFFERSON STRIsET, ABUTTING ON LOT 1 OF BLOCiI 11.,
IN THE CITY OF FORT COLLINS.
WHEREAS, The City Council has been petitioned bi> Clara
M. Brose, the owner of Lot 1, Block 11, of the City of Fort Collins,
upon which lot the irregular tract hereinafter described abutts,
to have the irregular tract at the Southeast corner of Block 11,
inside of property lines and property lines extended of East Pfounta.in
Avenue, Lincoln Avenue and Jefferson Street, vacated; and
WIIEREAS, It appears that said irregular tract has never
been used by the general public for street or other purposes, and
is separated by the curbs and gutters as now located from the used
protions of said streets, and that the holding of such irregular tract
by the City would involve payment of assessments by the City for any
special improvements that may be assessed against the same without,
any resulting benefit to the City at large; and said petition havin_;
been granted, upon payment to the City for special improvements
heretofore made and assessed against said tract; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That portion of the street area, as shown
by the plats of the City of Fort Collins, Colorado, lying East; of
and abutting upon Lot 1 in Block 11, in the City of Fort Collins,
Colorado, more particularly described as follows, to -wit:
Commencing at the Southeast corner of Lot 1,
Block 11, City of Fort Collins, Colorado,
thence East along the North property line of
East Mountain Avenue 26.20 feet, more or lens,
to the intersection of said line with the
Northwest property line extended of Lincolr
Avenue; thence North 41010' East along the
said Northwest property line extended of
Lincoln Avenue 13.99 feet, more or less, to
the intersection of said extended property
line with the Southeast property line of
Jefferson Street; thence North 48050' Priest
along the Southeast property line of Jefferson
Street 46.88 feet, more or less, to the North-
east corner of said Lot 1 in said Block 11;
thence South 41.4 feet, more or less, along
the East line of said Lot 1 to point of
beginning,
be and the same^is hereby vacated; provided that all expenses
incurred by reason of the adoption, passage and publication of
this ordinance, and all special improvement taxes assessed against
said irregular tract be paid, and also that all special improver.jent
taxes hereafter assessed be paid without abatement or allowance
upon account of the irregular shape of said tract or said Lot 1
of Block 11, on which said tract abutts.
Section 2. In the opinion of the City Council an
emergency exists for the preservation of the public health, peace
and safety, and this ordinance shall take effect upon its passa�,c
and publication under and by virtue of the authority contained
in Sections 6 and 7 of Article IV of the City Charter.
Introduced, read at length and adopted by the unanimous
vote of all the members of the City Council this 27th day of September,

I, A. J. ROSENOW, City Clerk of the City of Fort Collins,
do hereby certify and declare that the foregoing ordinance, cons;_sting
of two (2) sections, was duly proposed and read at length at a
regular meeting of the City Council held on the 27th day of September,
A. D. 1924, and was duly adopted and ordered published in the fort
Collins Expreas-Courier, a daily newspaper and the official news-
paper of the City of Fort Collins, by the unanimous vote of all
members of the Council, as an emergency ordinance, in accordant;, with
the provisions of Sections 6 and 7 of Article IV of the CiLy Cha'ter;
and thereafter, on to -wit: the 3o0 day of Se,v D.
1924, said Ordinance No. 20 was huly published in the Fort Collins
Express -Courier, a daily newspaper published in the City of Fo,�t
Collins, Colorado.
