WI-i REAS, The Northern Colorado Loan Association_,
a Colorado corporation, has this day filed and presented its
petition and application to the City Council as the owner of
the entire area of Circle Drive Subdivision of L. C. Moore's
Third Addition to the City of Fort Collins, Colorado, as shown
in the plat thereof annexed to said petition, which said plat
has been duly signed and acknowledged by the petitioner, grant-
ing, conveying, and dedicating the streets and alleys in said
Addition to the City of Fort Collins for the use of the public,
to be known as Circle Drive Subdivision of L. C. Moore's Third
Addition to the City of Fort Collins, Colorado, which said plat
is a replat of Blocks 1, 6, and 7, Lots 1 to 5 inclusive and
Lots 12 to 16 inclusive of Block 2, Lots 1 to 5 inclusive and
Lots 12 to 16 inclusive of Block 5, and the East 40 feet of Lots
1 to 10 inclusive of Block 8, as platted in L. C. f,fooreys Third
Addition to the City of Fort Collins, Colorado, which said
replat annexed to said petition shows that the proposed streets
aria alleys therein are to be in conformity as to courses and
anCles with the streets and alleys of adjoining portions of the
City of Fort Collins, and that all streets are to be duly brought
to the legally established grade in accordance with the require-
ments of the ordinances of the City of Fort Collins, and that
all necessary -ridges and culverts are t� .,e constructed
therein as required by the ordinances of the City of Fort
Collins, and the costs thereof are to be paid by the applicant,
and all taxes assessed against said territory have been paid;
and in said application the said applicant, for itself and its
grantees, covenants and agrees to and with the City of Fort
Collins that upon the acceptance of said application it is
expressly agreed and understood that the applicant and its
grantees covenant and agree that they will be bound by and
will observe and obey the ordinances in force and effect at
the time of the acceptance of said plat and hereafter adopted
respecting the installation and payment for local public
improvements; and
SVIEREAS, Said applicant has further petitioned
the City Council to vacate all of the streets and alleys as
now dedicated within said area;
NOW T1 7 1PORE, BE IT RESOLVED BY T1E CITY COUNCIL
OF TIE CITY OF FORT COLLINS, That the petition of The Northern
Colorado Loan Association, a Colorado corporation, be and the
same is hereby accepted and approved, and that all of the
streets and alleys within the area of Blocks 1, 6, and 7, Lots
1 to 5 inclusive and Lots 12 to 16 inclusive of Block 2, Lots
1 to 5 inclusive and Lots 12 to 16 inclusive of Block 5, and
the Bast 40 feet of Lots 1 to 10 inclusive of Block g of L. C.
1doorets Third Addition to the City of Fort Collins, Colorado,
be and the same are hereby vacated, and that the plat of said
area is hereby vacated.
BE IT F'JRTraR RESOLVED, That the plat of the area
designated as Circle Drive Subdivision of L. C. Moore+s Third
Addition to'the City of Fort Collins, Colorado, be and the same

is hereby accepted and approved as the official replat of the
territory embraced therein and knovm as Circle Drive Subdivi-
sion of L. C. Moore+s Third Addition to the City of Fort
Collins, Colorado, and the dedication of the streets and alleys
as laid out and designated on said plat is hereby accepted.
BE IT FURTHM RESOLVED, That the City Clerk be and
he is hereby authorized and directed to prepare a certified
copy of this Resolution, to which shall be attached a plat of
said Circle Drive Subdivision of L. C. Moore's Third Addition
to the City of Fort Collins, Colorado, and file the same with
the County Clerk and Recorder of Larimer County,. Colorado, for
record, and that a duplicate thereof be filed in the office
of the City Clerk, and that the applicant shall pay the cost
thereof.
BE IT FURTHER RESOLVED BY TIE CITY COUNCIL, That in
accepting and approving said plat the City of Fort Collins does
not assume any oblif,ations respecting the construction of sewer
lines or gas mains with respect to the service of said sub-
division, nor the improvements of sidewalks, streets, and alleys,
except as may be required and provided by the ov+ners of the
property within the limits of said subdivision, and except as
may be initiated by the owners of the property within the limits
of said subdivision in compliance with the terms and provisions
of the ordinances and charter of the City of Fort Collins.
BE IT FURTi1ER RESCLVED BY TIC CITY COUieCIL, That
the acceptance of said plat shall in no wise affect any assess-
ment or levy for special assessments heretofore made or to be
made for improvements already ordered or installed by the City
of Fort Collins.

City of Fort Collins at a regular meeting held this nth day
