HomeMy WebLinkAboutLOOMIS ADDITION BLOCK 280 - Filed RV-ROW VACATION - 2004-03-24ORDINANCE NO. 1920, BEING AN EMERGENCY ORDINANCE RELATING TO THE VACATING OF THE ALLEY LOCATED IN THE SOUTH HALF OF BLOCK 280 OF LOOMIS ADDITION TO THE CITY OF FORT COLLINS, RUN- NING NORTH AND SOUTH BETWEEN LOTS 22 AND 23 IN SAID BLOCK. "HEREAS, The City Council has been peti- tioned by Frank A. Somerville, the owner of the south half of Block 280, Loomis Addition to the City of Fort Collins, to have the alley in said block,running north and south between Lots 22 and 23, vacated; and WHEREAS, It appears from said petition, as well as the records of said City and the favorable report from the Coimnissioner of Works, that said alley has never been opened, accepted and used by the general public, and is not a public necessity for the residents of said Block 280, and that the opening and maintenance of the same would involve continued expense on behalf of the City without any resulting benefit to the pro- perty holders in said block or the City at large; therefore BB; IT ORDAINED BY THE CITY COUNCIL OFT THE CITY OF FORT COLLINS: Section 1. That the alley located in the south half of Block 280 of Loomis Addition to the City of Fort Collins, being a strip of land twenty (20) feet wide and two hundred feet (200) long between Lots 22 and 23 in said block, be and the same is hereby vacated, and from thence forthwith the said strip of land shall be V a-1 y CLM;c C171 OF FORT COLLINS treated as a part of said lots adjoining said tract and all right, title and interest therein shall become vested in the said Frank A. Somerville, the owner of Lots 22 and 23, in said Block 280, as provided by lain; provided that all expenses incurred by reason of the adoption, passage and publication of -this ordinance shall be paid cb�V said Somerville l Section 2. In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety and this ordinance shall taT:te effect upon its passage and publication, under and in virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter.
