Gentlemen:
November 12, 1937
I have investigated the raatter of the
plat of subdivision of Lot 1, Block 82, in the City of
Fort Collins, filed August 13, 1910, wnich shows a 10 foot
alley between Lot 4 and Lots 1, 2 and 3 running in a Northerly
direction for 100 feet and from my investigation I find that
this alley was never dedicated to the public or accepted by
the City and the same has never been used or occupied as a
public alley. I also find that a garage has been erected on
the North end thereof and it would not be feasible or practical
to open the same for public use.
It is therefore my recommendation that the
said strip designated as an alley be vacated and that the
City disclaim any ri0ht, title or interest thereto.

vEEREAS, Lot 1 of Block 82, in the City of
Fort Collins, according to the plat filed January 18, 1873,
was subdivided on January 13, 1910 accordinc, to a plat filed
August 13, 1910, and described as Subdivision of Lot 1, Block
82, in the City of Fort Collins, into five (b) lots, numbered
1 to b inclusive, and said plat shows an alley ten feet wide
on Olive Street between Lot 4 and Lots 1, 2 and 3; and

subdivision plat and has never been accepted by the City or
opened 01' used by the public; and

Engineer, it would not be practical or feasible to open said
alley for the public; and

of Lot? 1, 2 and 3 in said Block 82, has requested that this
10 foot strip be vacated, and that the City Council adopt a
i?esoiution, disclaiming any right, title or interest in and
to said strip; and

that it would be to the best interests of said City that the

between Lot 4 and Lots l,N and 3 of the sub division of Lot
1, Block 82, in the pity of Zort Collins, Colorado,
according to the plat filed "u ust 13, 1910, be and the
same is hereby vacated and the City of r'ort Collins does
hereby disclaim any right, title or interest in and to
said 10 foot strip and renounces and releases any claim which
the said City i��ay have because of its designation as an
alley on said subdivision plat.
Passed and adopted at a regular meeting of
the City Council., held this 19th day of November, A. D.1937.
