TO SUBDIVISION AGREEMENT
VICTORIA LAKES, P.U.D.

The Subdivision Agreement between the CITY OF FORT COLLINS and PROS-
PECT II CORPORATION dated the 31st day of May, A.D. 1979, is hereby amended
as follows:
1. Second Paragraph - The Subdivision name is changed from Victoria
Lakes, a planned unit development, to Heritage Lakes, a planned
unit development.
2. Section 7, Other Requirements, is amended to read:
The Developer agrees to submit to the City for approval
revised Utility Plans which will include the following:
1. The curb, gutter and sidewalk on Prospect Road
shall be moved south 10'.
2. The foot bridge shall be submitted in detail
that shall be acceptable to the City.
3. The east fire access road shall be moved to
agree with the site plan. The improvement to
this road shall be detailed and shall be ac-
ceptable to the City.
4. The entrances to the access ways shall be
revised to agree with the site plan.
The approval of these revisions shall be obtained before
the issuance of any building permits.
3. Section 6, Streets, the following is added as Paragraph i.
i. The City shall repay the Developer for the cost of
removal and replacement of the curb and gutter on
Prospect Road except that existing curb and gutter
which would have to be replaced due to damage or
undermining shall be at the Developer's expense.
