HomeMy WebLinkAboutUNIVERSITY ACRES - Filed OA-OTHER AGREEMENTS - 2004-03-08MEMORANDUM OF AGREEMENT THIS MEMORANDUM OF AGREEMENT, made and entered into this 20th day of August, A.D. 1964, by and between the City of Fort Collins, a municipal corporation, hereinafter designated as City, and University Acres, Inc., a Colorado corporation, hereinafter designated as Owner, WITNESSETH: WHEREAS, heretofore curb, gutter, and sidewalk were installed in the 800 and 900 blocks of East Elizabeth Street, Fort Collins, Colorado, by Owner, and WHEREAS, said installation was made in accordance with a grade which appears too high in relation to properties on the north side of Elizabeth Street, and WHEREAS, it is necessary that said curb, gutter, and sidewalk be removed and new curb, gutter, and sidewalk installed in accordance with a correct grade, and WHEREAS, it is necessary to construct a twelve -inch (12") storm sewer from Elizabeth Street south to the intersection of Garfield and Green Streets to connect to the existing storm sewer in Garfield Street, and WHEREAS, the parties hereto have agreed upon the sharing of the cost of the removal of the curb, gutter, and sidewalk originally installed, the replacement of such curb, gutter, and sidewalk in accordance with a new grade to be established by the City Engineer and the construction of said twelve - inch (12") storm sewer. NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually agreed as follows: 1. The removal of the existing curb, gutter, and sidewalk shall be done by City. 2. The City Engineer shall establish the new lower grade for the curb, gutter, and sidewalk to replace that which is removedo and the new curb, gutter, and sidewalk shall be installed by Owner. 3. The twelve -inch (12") storm sewer above mentioned shall be installed by Owner in accordance with grades established by the City Engineer. 4. Each of the parties hereto shall pay one-half ('2) of the total cost of the above: mentioned projects, which said total cost and settlement therefor shall be made immediately upon completion of said projects. IN WITNESS WHEREOF, City has caused its corporate name to be hereunto subscribed by its Mayor and its corporate seal affixed, attested by its City Clerk pursuant to resolution adopted by the City Council of the City of Fort Collins on the day of August, 1964, and Owner has caused its corporate name to be hereunto subscribed by its President and its corporate seal to be hereunto affixed by its Secretary the day and year first hereinabove written.
