OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A
UTILITY EASEMENT IN THE PROSPECT II P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by
approval of replats containing notation of such vacation; and

WHEREAS, the Owner of the Prospect II P.U.D. has requested the vacation of a portion
of a utility easement, more particularly described below; and
WHEREAS, a portion of a building constructed on said P.U.D. encroaches into a portion
of a 15 foot wide utility easement; and
WHEREAS, by vacation of the portion of the 15 foot utility easement described below,
the encroachment will be eliminated and the Owner will be able to obtain title insurance; and
WHEREAS, all public and private utility agencies have been notified of the vacation
request and report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that the easement area more particularly described as follows, to wit:
That portion of Prospect II P.U.D. in the City of Fort Collins, Latimer County, Colorado
described as follows:
Beginning at the Northeast corner of said Prospect II P.U.D.; thence along the East line of
said Prospect it P.U.D. South 00°44'00" East 162.01 feet to the Easterly prolongation of
the North line of an existing 15 foot wide utility easement; thence along said prolongation
and North line North 90°00'00" West 42.00 feet to the True Point of Beginning; thence
along said North line North 90°00'00" West 160.18 feet; thence South 29' 16'02" East
5.73 feet; thence North 90°00'00" East 150.18 feet; thence North 00°44'00" West 5.00
feet to the True Point of Beginning. Containing 147.44 square feet more or less.
be and the same hereby is vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of
Fort Collins held this 18th day of December, A.D. 1995.
