Amendment Agreement No.1
THIS AGREEMENT, made and entered into this ay of A= t L � ,
196, by and between the CITY OF FORT COLLINS, COLORADO, a municipal
corporation ("City"), and SOMERSET LIMITED, a Colorado limited partnership
("Developer"), is an amendment to that certain Development Agreement dated
the 17th day of December, 1984, by and between the City and The Landings
Ltd. By this Agreement, the aforesaid Development Agreement is hereby
amended in the following particulars:
The following is added to paragraph 2.C,:
The Developer agrees to construct and maintain a 20 foot wide
emergency access loop constructed of a 4 inch thick base course prior
to the issuance of the building permits for the buildings shown in
red on the attached Exhibit "A". Said loop shall be constructed in
the location of the parking loop as shown on the site plan with the
exception that: the northern part of the loop shall be constructed in
the right -of -nay for Troutman Parkway to provide a second point of
access to Boardwalk Drive for the development. Not withstanding the
foregoing, it is understood that no Certificates of Occupancy shall
be issued for said buildings until Troutman Parkway is completed and
approved by the City.

The Landings, LTD., having heretofore conveyed all of its interest in
Somerset P.D.D. to Somerset LTD., does hereby consent to and concur in the
aforesaid amendment to that development agreement between the City of Fort
Collins and Landings, LTD., as pertaining to the Somerset P.U.D.
