THIS AGREEMENT, made and entered into this 3j0� day of ' 1984,
by and between the CITY OF FORT COLLINS, COLORADO, a municipal corporation
(City), and DUECK DEVELOPMENT, INC. (Developer), is an amendment to that
certain Development Agreement dated the 20th day of July, 1984, by and between
the parties hereto concerning SOMERLY AT PROVINCETOWNE PUD, PHASE I.
By this Agreement, the aforesaid Development Agreement is hereby amended
in the following particulars:
Special Conditions; paragraph 2-B is amended to add
the following sentence:
"If Special Improvement District No. 81 is not formed
and construction of Trilby Road is not completed by
December 31, 1985, Trilby Road shall be constructed
by the Developer during the 1986 construction season
and oversizing repayment will be in accordance with
City Code 99-6-F."
IN WITNESS WHEREOF, the parties hereto have set their hands the day
and year first above written.
