VACATING .A PORTION OF THE UTILITY EASEMENT DEDICATED ON
LOT 93 OF THE ARTHUR C. SHEELY 3RD SUBDIVISION

Y1I WHEREAS, Section 2-353 (4) of the Code of the City of For
_J Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way,, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of Lot 93 of the Arthur C. Sheely 3rd
Subdivision has requested that the City vacate a portion of the
utility easement dedicated on Lot 93 of the Arthur C. Sheely 3rd
Subdivision and more particularly described below; and

WHEREAS, the vacation request has been reviewed and approve
by the pertinent City and private utilities, and they report no
objections.

NOW, THEREFORE, be it resolved by the Planning and Zoning
x Board of the City of Fort Collins, that a portion of the utility
easement dedicated on Lot 93 of the Arthur C. Sheely 3rd
Subdivision more particularly described as follows to wit:
A part of Lot 93, Arthur C. Sheely 3rd Subdivision, City
of Fort Collins, State of Colorado, which is contained

�- within the boundary lines which begin at a point which
bears West 10.00 feet and again North 5.00 feet from the
Southeast corner of said Lot 93, and run thence West
- 32.00 feet; thence North 5.00 feet; thence East 32.0
y' feet thence South 5.00 feet tho the point of beginning.
