HomeMy WebLinkAboutPRESTON-KELLEY SUBDIVISION - Filed OA-OTHER AGREEMENTS - 2004-01-27ADDENDUM TO SUBDIVISION AGREEMENT THIS AGREEMENT, made and entered into this ;Q nd day of A pri 1 , 1980, by and between the CITY OF FORT COLLINS, COLORADO, a Municipal Corporation, hereinafter sometimes designated as the "City", and HEWLETT-PACKARD COMPANY, hereinafter sometimes designated the "Developer", D V T7 A hiRT.F The parties hereto have executed a Subdivision Agree- ment dated the day of February, 1980, regarding Preston -Kelley Subdivision. Subsequent to the execution of said Agreement, the parties have discussed certain security measures required by the Developer at their production facilities. These security measures are felt to be part of the subdivision agreements between the parties in that their installation is deemed an integral Hart of the subdivision and development of the property and the germs and provisions with regard to the same as set forth in this Agreement shall be applicable to the property, so long as the Developer maintains production facilities on the property. NOW,, THEREFORE, in consideration of the premises and in supplement to the Subdivision Agreement heretofore entered into between the parties, the parties agree as follows: 1. The Developer shall be permitted to install a seven foot W) chain link fence with three (3) strands of wire, which shall be barbed, around the t4est, South and East property lines of Preston -Kelley Subdivision, or at such other locations as the same may now be installed. 2. The Developer has, or will install, an architectural berm along the East-West portion of the North Boundary of Preston -Kelley Subdivision. On the North property line which runs on a diagonal at the East end of the East-West portion of the North boundary line, said fence may be installed on the property line. 3. The maintenance, construction or installation of said fence is considered by the City to be an extension of a non -conforming use which the Developer will be permitted to continue, so long as such security measures are required by the Developer at its manufacturing facilities within Preston - Kelley Subdivision. 4. This Agreement is supplemental to the Subdivision Agreement: heretofore executed by and between the parties and does not modify or change any of the conditions thereof.
