This Agreement is executed this 6Mrd day of Sort , 1982, by and
between the City of Fort Collins, Colorado (CITY) an sprey, Inc. (OSPREY)
and constitutes an addendum to that certain Agreement between Osprey, Inc.,
aka Osprey Homes, Inc. and the City of Fort Collins dated October 16, 1979,
and entitled: Subdivision Agreement for the Pier Condominiums at the
Landings, P.U.D.
In consideration of their mutual promises and the covenants contained
herein, the adequacy of which is hereby recognized, the parties hereto do
hereby amend that certain subdivision agreement dated October 16, 1979, and
pertaining to the Pier Condominiums at the Landings, P.U.D. by the addition
of the following provisions:
9. Warren Trunk Sanitary Sewer
(a) Prior to the issuance of any additional building permits, the
Developer agrees to pay the City the sum of $3,895.04 as
repayment for the Warren Trunk Sanitary Sewer for the purpose
of compensating the City for building permits previously
issued by the City in said P.U.D.
(b) Each additional residential building for which a building
permit is requested will require payment of the sum of
$973.76 to satify the requirements of repayment of Warren
Trunk Sanitary Sewer, which payments shall be received by the
City prior to the issuance of any such building permit.
Except as above amended, the aforesaid subdivision agreement shall
continue in full force and effect.
IN WITNESS WHEREOF, the parties hereto have set their hands and seals
the day and year first above written.
