OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
W VACATING A PORTION OF A UTILITY EASEMENT
w DEDICATED ON LOTS 49 AND 50 OF
PARAGON POINT P.U.D. PHASE FOUR

WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Q
Collins authorizes the Planning and Zoning Board to vacate certain
� rights -of -way, by resolution or by approval of replats containing
CO F notation of such vacation; and

aw WHEREAS, the Owner of Lots 49 and 50 of Paragon Point P.U.D.
Phase Four has requested that the City vacate a portion of the rear
lot utility easement on said lots, more particularly described on

� Exhibit "A" attached hereto and incorporated herewith by this
o reference; and

a WHEREAS, the portions of the easement proposed for vacation
..0 are not necessary to retain for utility installation and
maintenance purposes and the vacation request has been reviewed and

approved by the pertinent City and private utilities, and they have
no objections.

? a NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the rear lot
w utility easement on Lots 49 and 50 of Paragon Point P.U.D. Phase
ora Four, more particularly described on Exhibit "A", attached hereto
and incorporated herewith, be and is hereby vacated.

A part of Lots 49 and 50 of Paragon Point P.U.D. Phase Four, City of Fort
Collins, County of Larimer, State of Colorado, which is contained within the
boundary lines which begin at the Northeast corner of said Lot 49, and run
thence S 71' 56' 36" E 30.90 feet; thence S 04' 10' 36" W 6,18 feet; thence
N 710 56' 36" W 31.66 feet; thence N 850 43' 00" W 26.26 feet; thence N 04'
10' 36" E 6.00 Feet; thence S 85' 43' 00" E 27.00 feet to the point of
beginning.
