BEING AN ORDINANCE VACATING A UTILITY EASEMENT IN THE ALVIN
L. MILLER FOOTHILLS SUBDIVISION SECOND FILING
WHEREAS, the City Council has been petitioned to vacate a utility
easement in the Alvin L. Miller Foothills Subdivision Second Filing, according
to the recorded plat thereof, said easement to be vacated being more particularly
described as follows, to -wit:
and
Begin at the Northwest corner of Lot 82 of the Alvin L.
Miller Foothills Subdivision Second Filing, thence S. 89045'
E. 10.0 feet, thence S. 00°15' W. 102.0 feet, thence south-
westerly to a point 15.0 feet N. 00°15' E. from the South-
west corner of said Lot, thence N. 00015' E. 105.0 feet to
beginning;
WHEREAS, it appears that this easement is not now needed nor will it
be needed in the future for the installation of any utilities, and
WHEREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of said
easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following easement, more particularly described as follows,
to -wit:
Begin at the Northwest corner of Lot 82 of the Alvin L.
Miller Foothills Subdivision Second Filing, thence S. 89045'
E. 10.0 feet, thence S. 00*15' W. 102.0 feet, thence south-
westerly to a point 15.0 feet N. 00015' E. from the south-
west corner of said Lot, thence N. 00*15' E. 105.0 feet to
beginning;
be and the same hereby is abolished, vacated and abated.
Introduced, considered favorably on first reading and ordered
published this LCt' day of November, A. D. 1965, and to be presented for final
passage on the 2nd day of December, A. D. 1965.
