4IACATING CERTAIN EASEMENTS CONTAINED IN LOT 40 AND LOT 41,
INDIAN HILLS SUBDIVISION, SECOND FILING, IN THE CITY OF
FORT COLLINS, COLORADO.
WHEREAS, the Plat of Indian Hills Subdivision, Second Filing,
in the City of Fort Collins, Colorado, recorded in the office of the
Clerk and Recorder of Larimer County on April 8, 1959, shows certain
easements in said Lots 40 and 41, Indian Hills Subdivision, Second
Filing, and
WHEREAS, said easements have never been used by the public,
and there is no necessity for their use as easements; which said easements
are more particularly described as follows:
An easement which is the Easterly six (6) feet of Lot 40, and
an easement which is the Westerly six (6) feet of Lot 41,
Indian Hills Subdivision, Second Filing, in the City of Fort
Collins, Colorado, which is part of the South one-half of
the Northeast one -quarter of Section 24, Township 7 North,
Range 69 West of the 6th P. M., Larimer County, Colorado,
and contained in the Plat of said Subdivision, which Plat
is dated October 20, 1958, and recorded April 8, 1959.
AND, WHEREAS, the contract purchasers of said Lots 40 and
41, and the owners of the Subdivision, less certain lots which have
been previously sold, have petitioned the Council of the City of Fort
Collins to cause the same to be vacated, and
WHEREAS, the Council of the City of Fort Collins is of the opinion
that it will be to the best interests of the City to vacate said easements.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1, That those certain easements in Lot 40 and Lot 41,
Indian Hills Subdivision, Second Filing, in the City of Fort Collins,
Colorado, more particularly described as follows, to -wit:
An easement which is the Easterly six (6) feet of Lot 40, and
an easement which is the Westerly six (6) feet of Lot 41,
Indian Hills Subdivision, Second Filing, in the City of Fort
Collins, Colorado, which is part of the South one-half of
the Northeast one -quarter of Section 24, Township 7 North,
Range 69 West of the 6th P. M., Larimer County, Colorado,
and contained in the Plat of said Subdivision, which Plat
is dated October 20, 1958, and recorded April 8, 19599
be and the: same are hereby vacated, abolished and abandoned,
Introduced, considered favorably on first reading, and
ordered published this 19th day of October, A. D. 1961, and to be
presented for final passage on the 9th day of November
