FEE— $.00 ORDINANCE N0. 127 , 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE FRONTAGE ROAD LOCATED ADJACENT TO LOTS 29 THROUGH 40 ON THE REPLAT OF A PART OF FAIRWAY ESTATES WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of the frontage road located on the Replat of a Part of Fairway Estates, set forth in more particular below; and WHEREAS, this vacation will facilitate the construction of a commercial building; and WHEREAS, a rededication of the frontage road will be made to compensate for the portion vacated by this Ordinance; and WHEREAS, some utilities do exist in the right-of-way of this road and a utility easement is being rededicated in the portion to be vacated to accommodate those existing utilities; and WHEREAS, rededication of this portion as a utility easement and the dedication of additional easements satisfies the needs and concerns of the utilities involved; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced of injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of the frontage road located adjacent to Lots 29 through 40 of the Replat of a Part of Fairway Estates, set out more particularly as follows, to wit: The east forty feet of the frontage road as platted adjacent to Lots 29 through 40 of the Replat of a Part of Fairway Estates be, and the same hereby is, vacated, abated and abolished. Introduced„ considered favorably on first reading and ordered published this 15th day of October, A.D. 1985, and to be presented for final passage on the 5th day of November, A.D. 1985.
