Box 580 Fort Collins, CO 80522 Dear Bob: Attached herewith are the plans and calculations illustrating the method we, have taken to treat the drainage generated on the Four Seasons Fourth Filing site. The approach taken for the Fourth filing correlates closely with that used for the Third Filing. Detention on site is difficult due to grading requirements and the subsequent destruction of a sizeable number of existing apple trees. Therefore, we propose allowing the runoff to flow directly into the curb and gutter along Arbor Avenue. The runoff will then follow the routing of runoff from the Third Filing; that is east along Arbor Avenue to Tradition Drive then south to Bonita Avenue then east. across Tradition Drive in the existing valley pan and continuing east along the south curb and gutter of Bonita Avenue; from there the runoff will flow in the west curb and gutter of Benthaven Street. The runoff will flow south to the catch basins in Benthaven where it will be piped east into the detention pond just eastof the street. The attached calculations show that the street capacities of these existing streets are adequate for these additional flows. Calculations are attached to show the adequacy of the pond expansion. The drive- way set -back: from Arbor Avenue is supposed to be 50'. We request the following variances: Lot 165 - From 50' to 37' Lot 166 - From 50' to 45' Lot 174 - From 50' to 45' These distances still allow a two car length stacking area be- tween Arbor Avenue and the nearest driveways. College Fort Collins, CO Dear Mr. Ulrich: We have received ccFqDlaints recently about a drainage problem on the south side of Burgundy Court near the bike path entrance/exit. Apparently there is a low point in the gutter which causes a perpetual stand of water. In the winter, icing problems will subsequently occur and this will present an even greater nuisance than the current ponding of water. When one of the residents called Chism Homes to complain, she was told that the City was responsible for such problems. Please be aware that this is a mistaken presumption. Chapter 95 §95-34 of the Fort Collins Code states that: It shall be the duty of the City Engineer to have charge of all sidewalks, curbs and gutters and driveways within the limits of the City of Fort Collins and to see that the same are properly constructed and kept in repair, and in case any thereof shall become unsafe or out of repair, to order the same to be repaired at the expense of the property owner as herein provided...... The Code further states that failure to repair a sidewalk or curb and gutter deemed unsafe to the public will cause the required work to be performed by the City and. the cost of the repairs or reconstruction will be collected from the owner through the County Treasurer's office with the general property taxies. Please note also that this section of sidewalk and curb and gutter has not been constructed according to the plans on file in the City Engineer's office as required. I'm sure you can appreciate the concerns of the area residents. Solving this problem is in the best interests of all concerned - the residents, the City, and your company. Because one of the parties (Ron Strahle) who owns the land to the east and from whom you are seeking an easement is out of town and unable to be reached and because I have a copy of a letter agreeing to work out the easement, I will allow the item to be heard with the following two conditions. Before the City will file the project the easement must be submitted as well as the documentation for handling the street name changes. This must be accomplished within 30 days from the date of this letter. Because the detention pond cannot be built without this easement, you will be unable to get more than 35 building permits for Four Seasons Fifth both phases, until the storm drainage improvements are completed (as per the Development Agreement).
