The right-of-way vacation is the result of a platting error. Evidently the recorded plat dedicated more right-of-way than necessary. In reviewing the vacation requesl:, my analysis determines that the surveyor's claim is accurate. To make a long story shorter, the right-of-way to be vacated and retained (labeled as dedicated) is shown on the legal description sketch. The right-of-way to be vacated will be incorporated into Tract "A", which is owned by the Fox Hills Community Association. A ]! 5-foot utility easement will be dedicated in Tract "A" in replace of a Portion of the right-of-way to be vacated (see attached sketch). The final right-of-way along West County Road 38E will be 50 feet from centerline. Take a look at this and let me know if you have any questions. Meldrum Street P.O. Box 429 Port Collins, CO 80522 Dear Dick: 1 routed the proposed easement vacation for ox Hills, �2`daround to all the appropriate utilities. The only negative response was from eJoyce Takemoto's, US West concern is that they have an existing conduit in the right-of-way to be vacated. Even the 15-foot utility adjacent to the right-of-way does not adequately alleviate her concerns for the telephone conduit is not within the proposed utility easement. Therefore, before this proposed right-of-way vacation, the applicant will have to address US West concerns. If there any question, call me at 221-6605. Thanks.
